Export of Flowers (Jersey) Order 1972[1]
THE ENVIRONMENT AND PUBLIC SERVICES COMMITTEE, in pursuance of Article 16 of the Agricultural Marketing (Jersey) Law 1953,[2] orders as follows –

In this Order, unless the context otherwise requires –
“consignee’s number” means a number allocated by the Minister for Planning and Environment to a person to whom flowers exported from Jersey are consigned;
“export” means export by way of trade or business, and “exporter” shall be construed accordingly;
“inspector” means a person appointed by the Minister for Planning and Environment to act as such for the purposes of this Order.

(1) Every exporter who exports flowers by sea to a destination mentioned in the Schedule shall affix, or cause to be affixed, securely to the outside of each container in which such flowers are packed a label in such form, and of such size, as may from time to time be determined by the Minister for Planning and Environment.
(2) A label for the purposes of this Article shall be of such colour, shall bear such marks and shall contain such particulars as are specified in Article 3.

The label to be affixed to a container in which flowers are packed for export to a destination mentioned –
(a) in the first column of Part 1 of the Schedule shall be of the colour specified in the second column thereof, and shall bear the marks (if any) specified in the third column thereof, in relation to that destination, and shall contain the following particulars –
(i) the name of the destination in black letters, each not less than 2/5 of an inch (10 mm) in height,
(ii) the name and address of the consignee, in letters each of which is less in height than the name of the destination,
(iii) on the right-hand side, the consignee’s number in black figures each not less than one and one-quarter inches (31 mm) in height,
(iv) the number of containers consigned to that consignee,
(v) the name and address of the exporter;
(b) in the first column of Part 2 of the Schedule shall be of the colour specified in the second column thereof, and shall bear the marks (if any) specified in the third column thereof, in relation to that destination, and shall contain the particulars specified in sub-paragraph (a)(i), (ii), (iv) and (v).

(1) The Minister for Planning and Environment may from time to time approve the type of container in which flowers shall be packed for export, and different types of containers may be approved in respect of different flowers and different varieties, types and kinds thereof.
(2) The Minister for Planning and Environment, in relation to a type of container approved under this Article –
(a) shall specify –
(i) the external measurements of containers of that type,
(ii) the materials from which the containers shall be constructed,
(iii) the type of cover which shall be used to close the containers;
(b) may specify the manner in which and the material with which the containers shall be lined.

(1) An inspector, on production if so required of evidence of the inspector’s appointment, may require an exporter, and any other person acting as servant or agent of, or as contractor to, an exporter in connection with the export of flowers, to produce for examination any container in which the inspector has reasonable grounds for believing that flowers are packed for export, and it shall be the duty of the exporter, or any such other person as aforesaid, to comply with the requirement.
(2) Where, on an examination under paragraph (1), an inspector finds any container in respect of which any of the foregoing provisions of this Order have been contravened the inspector may, without prejudice to any proceedings in respect of that contravention, prohibit the export of the consignment in which that container is comprised until such time as the inspector is satisfied that those provisions have been complied with in respect of all the containers so comprised.

This Order may be cited as the Export of Flowers (Jersey) Order 1972.

Blue
A line coloured black, not less than 1/10 of an inch (2.5 mm) in width drawn from the bottom left-hand corner to a point on the top of the label one and one-half inches (38 mm) or there-abouts, from the top right-hand corner thereof.

This Order has been amended by the States of Jersey (Amendments and Construction Provisions No. 3) (Jersey) Regulations 2005. The amendments replace all references to a Committee of the States of Jersey with a reference to a Minister of the States of Jersey, and remove and add defined terms appropriately, consequentially upon the move from a committee system of government to a ministerial system of government
