The South Devon Health Care National Health Service Trust (Establishment) Amendment Order 1996

The Secretary of State for Health, in exercise of powers conferred on him by section 126(3) of the National Health Service Act 1977(1) and section 5(1) of the National Health Service and Community Care Act 1990(2) and of all other powers enabling him in that behalf, hereby makes the following Order:
Citation and commencement
1. This Order may be cited as the South Devon Health Care National Health Service Trust (Establishment) Amendment Order 1996, and shall come into force on 7th April 1996.
Amendment of Establishment Order
2. In Article 3 of the South Devon Health Care National Health Service Trust (Establishment) Order 1990(3) (functions of the trust)—
(a)in paragraph (1) for “section 5(1)(a)” there shall be substituted “section 5(1)(b)”;
(b)for paragraph (2) there shall be substituted the following new paragraph:—
“(2) The trust’s functions shall be—
(a)to provide and manage hospital accommodation and services at either or both of the following hospitals:—
(i)Torbay District General Hospital, Lawes Bridge, Newton Road, Torquay, Devon TQ2 7AA;
(ii)Dawlish Hospital, Barton Terrace, Dawlish, Devon;
and at any other hospital which is associated with either of those hospitals; and
(b)to manage community health services from Torbay District General Hospital, Lawes Bridge, Newton Road, Torquay, Devon TQ2 7AA and to provide the associated premises.”

Explanatory Note
This note is not part of the Order)
This Order amends the Order which established the South Devon Health Care National Health Service Trust to alter the purpose for which the trust has been established and to amend its functions. (The trust has, in exercise of its existing functions, assumed responsibility for the management of hospital accommodation and services provided from Torbay District General Hospital, and community health services formerly provided from St Michael’s House, Newton Abbot Hospital but now provided from Torbay District General Hospital, previously managed by the former Torbay Health Authority and for the ownership of the associated premises.)
This Order confers on the trust the purpose specified in section 5(1)(b) of the National Health Service and Community Care Act 1990—to provide and manage hospitals or other establishments or facilities—and amends the trust’s functions so that it is no longer required to own the premises at which it is to provide hospital services, and to alter the premises from which it is to provide community health services.
