The Air Navigation (General) (Amendment) Regulations 1997

The Secretary of State for Transport, in exercise of the powers conferred by Articles 42(1) and 42(2) of the Air Navigation (No. 2) Order 1995(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

1.  These Regulations may be cited as the Air Navigation (General) (Amendment) Regulations 1997 and shall come into force on 27th March 1997.

2.  The Air Navigation (General) Regulations 1993(2) shall be amended as follows:

(1) After regulation 18(1) there shall be inserted the following:

“(1A) For the purposes of article 42(2) of the Air Navigation (No. 2) Order 1995, the following height keeping performance capability is hereby prescribed, that is to say, a capability to ensure that:

(a)altimetry system error shall be in compliance with paragraph 2.1.1(2) of Document 7030/4-NAT Part 1 Rules of the Air, Air Traffic Services and Search and Rescue (ICAO Regional Procedures Fourth Edition—1987); and

(b)(i)in respect of aircraft first registered in a Contracting State on or after 1st January 1997 altitude can be automatically controlled within a tolerance band of +/−65 feet;

(ii)in respect of aircraft first registered in a Contracting State before 1st January 1997 altitude can be automatically controlled within a tolerance band of +/−130 feet.”

(2) In regulation 18(2), for “from flight level 275 to flight level 400” there shall be substituted “from flight level 285 to flight level 420”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Air Navigation (General) Regulations 1993. The following changes are made:
(1) A height keeping performance capability is prescribed. Aircraft registered in the United Kingdom flying within airspace prescribed for the purposes of minimum navigation performance and notified for the purpose of reduced vertical separation minima must carry equipment which have the prescribed height keeping performance capability (regulation 2(1)).
(2) An amendment is made to the airspace prescribed for the purposes of minimum navigation performance (regulation 2(2)).
