The Secretary of State, in exercise of the powers conferred on him by sections 6(3) and 15(6) of the Local Government Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement and application

1.—(1) These Regulations may be cited as the Local Government Act 1988 (Defined Activities) (Competition) (Amendment) (England) Regulations 1995 and shall come into force on 26th October 1995.

(2) These Regulations apply to defined authorities in England only.

Interpretation

2.  In these Regulations—

“the Legal Services regulations” means The Local Government Act 1988 (Competition) (Legal Services) (England) Regulations 1994(2);

“the supervision of parking regulations” means The Local Government Act 1988 (Defined Activities) (Competition) (Supervision of Parking, Management of Vehicles and Security Work) (England) Regulations 1994(3);

“the construction regulations” means The Local Government Act 1988 (Competition) (Construction and Property Services) (England) Regulations 1994(4).

Amendment to the legal services regulations

3.  Regulation 3 of the legal services regulations is amended as follows—

(a)after regulation 3(c) there is inserted—

“(cc)on or after 1st October 1997 by a county council or non-metropolitan district council which is not subject to a structural change; or”; and

(b)regulation 3(d)(ii) is omitted.

Amendment to the supervision of parking regulations

4.  Regulation 2 of the supervision of parking regulations is amended as follows—

(a)after regulation 2(c) there is inserted—

“(cc)on or after 1st October 1997 by a county council or non-metropolitan district council which is not subject to a structural change; or”; and

(b)regulation 3(d)(ii) is omitted.

Amendment to the Construction regulations

5.  Regulation 3 of the construction regulations is amended as follows—

(a)after regulation 3(c) there is inserted—

“(cc)on or after 1st October 1997 by a county council or non-metropolitan district council which is not subect to a structural change; or”; and

(b)regulation 3(d)(ii) is omitted.

Explanatory Note

(This note is not part of the Regulations)
These regulations amend three earlier sets of Regulations which apply the compulsory competitive tendering requirements of the Local Government Act 1988 (the CCT requirements) respectively to legal services, construction and property services and to the supervision of parking, management of vehicles and security work. In each case the effect of the amendment is to apply the CCT requirements from specified dates to county councils and non-metropolitan district councils which are not subject to a structural change pursuant to local government reorganisation.
