Rulemaking authority.
436.520. 1. The board shall promulgate and enforce rules for
administration and enforcement of sections 436.400 to 436.520 including the
establishment of the amount of any fees authorized thereunder for the
transaction of its business and for standards of service and practice to be
followed for the licensing and registration of providers, sellers, and preneed
agents deemed necessary for the public good and consistent with the laws of
this state. Such fees shall be set at a level to produce revenue which does
not substantially exceed the cost and expense of administering this chapter.
2. Any rule or portion of a rule, as that term is defined in section
536.010, that is created under the authority delegated in this section shall
become effective only if it complies with and is subject to all of the
provisions of chapter 536 and, if applicable, section 536.028. This section
and chapter 536 are nonseverable and if any of the powers vested with the
general assembly under chapter 536 to review, to delay the effective date, or
to disapprove and annul a rule are subsequently held unconstitutional, then
the grant of rulemaking authority and any rule proposed or adopted after
August 28, 2009, shall be invalid and void.
