Rules and regulations, department to adopt--procedure.
190.185. The department shall adopt, amend, promulgate, and enforce such
rules, regulations and standards with respect to the provisions of this
chapter as may be designed to further the accomplishment of the purpose of
this law in promoting state-of-the-art emergency medical services in the
interest of public health, safety and welfare. When promulgating such rules
and regulations, the department shall consider the recommendations of the
state advisory council on emergency medical services. Any rule or portion of
a rule promulgated pursuant to the authority of sections 190.001 to 190.245 or
sections 190.525 to 190.537 shall become effective only if it complies with
and is subject to all of the provisions of chapter 536 and, if applicable,
section 536.028. This section and chapter 536 are nonseverable and if any of
the powers vested with the general assembly pursuant to chapter 536 to
review, to delay the effective date or to disapprove and annul a rule are
subsequently held unconstitutional, then the grant of rulemaking authority
and any rule proposed or adopted after August 28, 2002, shall be invalid and
void.

has been promulgated pursuant to the provisions of chapter 536, RSMo.
