Death benefits, amount--surviving spouse entitled to benefits, when.
56.830. 1. A death benefit of ten thousand dollars shall be paid to the
designated beneficiary of every active member upon the member's death or to
the member's estate if there is no designated beneficiary.
2. If a member dies before retirement, after becoming eligible for
retirement, the member's surviving spouse, if such surviving spouse has been
married to the member for at least two years prior to the member's death,
shall be entitled to survivorship benefits pursuant to option 1 as set forth
in section 56.827 as if the member had retired on the date of the member's
death.
3. If a member with twelve or more years of service dies before becoming
eligible for retirement, the member's surviving spouse, if such surviving
spouse has been married to the member for at least two years prior to the
member's death, shall be entitled to survivor benefits pursuant to option 1
as set forth in section 56.827 as if the member retired on the date of the
member's death.
