DECISION No. 1387/QD-TTg OF DECEMBER 29, 2005, ON HANDLING OF ILLEGAL REGULATIONS ON INVESTMENT PREFERENCES AND INCENTIVES, PROMULGATED BY PROVINCIAL/MUNICIPAL PEOPLE'S COMMITTEES
THE PRIME MINISTER
Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the November 12, 1996 Law on Promulgation of Legal Documents, and December 16, 2002 Law No. 02/2002/QH11 Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents;
Pursuant to the December 3, 2004 Law on Promulgation of Legal Documents by People's Councils and People's Committees;
Pursuant to the Government's Decree No. 135/2003/ND-CP of November 14, 2003, on examination and handling of legal documents;
At the proposal of the Minister of Finance in Official Letter No. 11236/BTC-PC of September 7, 2005, the Minister of Planning and Investment in Official Letter No. 5834 BKH/PTDN of August 29, 2005, the Minister of Justice in Report No. 2451/BC-BTP of August 17, 2005, the Minister of Natural Resources and Environment in Report No. 70/BC-BTNMT of August 1, 2005, the Minister of Trade in Official Letter No. 5466/TM/KH-DT of November 8, 2005, the Minister of Home Affairs in Official Letter No. 3275/BNV-TT of November 11, 2005, and the Minister-Director of the Government Office,
DECIDES:
Article 1.- Regarding the effect of illegal regulations
1. To suspend the implementation effect of illegal regulations on investment preferences and incentives, promulgated by 31 provinces and centrally run cities named in the List in Appendix I to this Decision, as from January 1, 2006, except cases defined in Clause 2 of this Article.
2. For illegal provisions on investment preferences and incentives in documents, mentioned or not yet mentioned in the List in Appendix I to this Decision, which have been annulled or replaced by other legal documents by provincial/municipal People's Committees before the effective date of this Decision, their implementation effect shall cease according to the provisions of the annulling or replacing legal documents.
Article 2.- Responsibilities of provincial/municipal People's Committees
1. The People's Committees of 32 provinces and centrally run cities (including Can Tho city and Hau Giang province divided and separated from former Can Tho province) named in the List in Appendix I to this Decision shall have to immediately annul the existing illegal provisions on investment preferences and incentives.
2. Provincial/municipal People's Committees shall have the responsibilities:
a/ To review by themselves, suspend the implementation of, and annul immediately the existing illegal regulations on investment preferences and incentives which are not yet mentioned in the List in Appendix I to this Decision;
b/ To make lists of investment licenses or investment preference certificates containing illegal regulations which they have granted to investors before January 1, 2006, according to a set form, and send them to the Ministry of Planning and Investment, the Ministry of Finance, the Ministry of Justice and the Government Office for sum-up and report thereon to the Prime Minister for consideration and decision;
c/ To report to the Prime Minister on the results of implementation of Clause 1 (if any) and Points a and b, Clause 2 of this Article before March 1, 2006.
Article 3.- Responsibilities of concerned ministers and heads of agencies
1. The Minister of Planning and Investment:
a/ To assume the prime responsibility for, and coordinate with the Minister of Finance, the Minister of Justice, the Minister of Natural Resources and Environment, the Minister of Trade, the Minister-Director of the Government Office, and heads of concerned ministries, branches and agencies in, overseeing the implementation of this Decision, and report on the results of implementation to the Prime Minister before July 1, 2006;
b/ To assume the prime responsibility for, and coordinate with the Minister of Finance, the Minister of Justice, the Minister of Natural Resources and Environment, the Minister of Trade, the Minister-Director of the Government Office, and heads of concerned ministries, branches and agencies in, reviewing or revising according to their competence, or propose competent state agencies to revise regulations on investment preferences and incentives in accordance with the Investment Law which was passed on November 29, 2005, by the XIth National Assembly at its 8th session.
2. The Minister of Home Affairs shall assume the prime responsibility for, and coordinate with the Minister of Justice, heads of concerned ministries, branches and agencies, and presidents of provincial/municipal People's Committees which promulgated illegal regulations-containing documents in, guiding responsible agencies and persons to strictly examine the responsibilities of agencies, officials and employees who had advised on, compiled, evaluated, submitted, approved, signed, and promulgated, documents containing illegal regulations on investment preferences and incentives.
Article 4.- Implementation effect
This Decision takes effect as from January 1, 2006.
Ministers, heads of ministerial-level agencies, heads of government-attached agencies and presidents of provincial/municipal People's Committees shall have to implement this Decision.
