The Senate and Chamber of Deputies of the Argentine Nation assembled in Congress, etc. sanction with force of Law:

ARTICLE 1 Appropriate the TREATY FOR THE CREATION OF THE SUDAMERICAN COUNCIL OF THE "CONSUDE" DEPORT, adopted at Belem do Pará BREPUBLICA FEDERATIVA del BRASIL. on 4 May 2002, which consists of VEINTIUN (21) articles and UN (1) Act of Rectification, whose authenticated photocopy is part of this law. ARTICLE 2 Contact the national executive branch.

TREATY FOR THE CREATION OF THE SUDAMERICAN DEPORT COUNCIL "CONSUDE"

The States signatories to this Treaty, henceforth called "The Parties", which are identified at the end of this document, gathered in Belém do Pará, Brazil, four days from May of the year two thousand:

CONSIDERING

(a) That at the First Meeting of State Sports Agencies of South America, held in Santiago de Chile on 7 and 8 July 1991, with the participation of delegates from Argentina, Bolivia, Colombia, Chile, Ecuador, Paraguay, Peru and Uruguay, it was agreed to create the South American Sports Council (CONSUDE) in order to coordinate the related agencies that integrate it and raise the level of development and performance of sport and recreation in the respective countries;

(b) That at the CONSUDE meeting held in Asunción, Paraguay, in March 1998, with the participation of delegates from Argentina, Bolivia, Colombia, Chile, Ecuador, Paraguay, Peru, Uruguay and Venezuela, a draft Statutes of the organization was adopted;

(c) That at the meeting of the CONSUDE held in São Paulo, Brazil, on 26 July 2000, it was agreed to begin the process of constitution of the CONSUDE as an international intergovernmental body; and

(d) That the CONSUDE meeting held in Lima, Peru, on 26 November 2002, adopted the final basis for the drafting of the statutes of the organization.

Agree to the following:

ARTICLE I . The South American Sports Council is established, henceforth, in the present statutes, the "CONSUDE", as an intergovernmental organization that aims to promote and facilitate, in coordination with the governmental sports agencies of the member states and with the international sports agencies, the improvement of the legislation, organization, policies and programs of dissemination, promotion, development and protection of physical activity and sport.

ARTICLE II . The CONSUDE will have its own legal personality and capacity to celebrate all kinds of acts and contracts permitted by law and to intervene in any judicial or administrative action in defence of its interests.

OBJECTIVES

ARTICLE III El The CONSUDE will have the following objectives:

(a) Promote mechanisms for bilateral, multilateral and regional cooperation among countries to overcome sports levels;

(b) Promoting and sponsoring sports skills between two or more countries;

(c) Promote the exchange of human, technological, documentary and bibliographic resources in sports;

(d) Promoting cooperation among Parties for the development of physical culture, recreation and sport for all;

(e) To promote the harmonization of the sporting laws of the Parties;

(f) Promote collaboration with the Ibero-American Sports Council (CID) and other international sports organizations;

(g) Promote ethics and clean play in South American sport;

(h) To promote the continued exchange of information and experiences of each Party regarding structures, legal norms and administrative organization as a means of promoting mutual enrichment;

(i) Promote South American events at all student levels and sport for all for purposes of cultural integration and exchange;

(j) Promote national sport, physical education and recreation policies in the respective Governments to form part of national economic and social development strategies;

(k) Structure of functional mechanisms for documentary exchange in the field of dissemination; sports science; technical and methodological orientation of activities and competencies; development of sports organizations; infrastructure; planning; and financing;

(l) Generate common criteria and mechanisms and practical measures to prevent and eradicate doping and violence in sport; and

(m) Promote high-performance sports centres that can serve a number of countries in their goals of raising their international competitive standards.

IDIOMES

ARTICLE IV O The official languages of CONSUDE will be Spanish and Portuguese.

MEMBERS

ARTICLE V O They shall be members of the CONSUDE, the South American States which ratify or accede to this Treaty, in accordance with their respective legal systems and the procedure established in these statutes. Member States shall be represented in CONSUDE by the senior authorities of their respective government sports agencies.

BODIES

ARTICLE VI O They are organs of the CONSUDE:

(a) The General Assembly;

(b) The President, Vice-Presidents and Executive Secretary;

(c) The Executive Committee; and

(d) The Working Committees.

GENERAL ASSEMBLY

ARTICLE VII . The General Assembly is the highest authority of CONSUDE and will be composed of all member States. Delegations of the member States of CONSUDE to the General Assembly shall be composed of a maximum of three delegates, one of whom shall have the right to vote.

ARTICLE VIII La The General Assembly shall have the following powers:

(a) To elect the President and the Vice-Presidents;

(b) Adopt resolutions and recommendations and know their implementation;

(c) Adopt the strategic plan, the annual management plan and the budget;

(d) Draft, approve and modify the "South American Sport Charter";

(e) Adopt operating regulations; and

(f) Designate delegates to other international sports bodies.

REGULAR AND EXTRAORDINARY ASSEMBLY

ARTICLE IX . The Assembly will meet in regular session once a year. Extraordinary meetings may be convened by agreement of the Executive Committee or at the request of the majority of its members. The quorum for session will be the simple majority of member States.

PRESIDENT, VICEPRESIDENTS AND SECRETARY-GENERAL

ARTICLE X . The President and Vice-Presidents of the CONSUDE shall be elected by the General Assembly. The election will be made on the basis of the senior authorities of the governmental sports agencies of the respective member States that are postulated for this purpose.

The positions of the President and Vice-Presidents of the CONSUDE may be vested in the superior authority of the same government agency of sport for a single consecutive time.

The President shall have the judicial and extrajudicial representation of CONSUDE.

The first Vice-President shall be responsible for matters related to institutional management (legislation, policies, organization, etc.).

The second Vice-President shall be responsible for matters relating to physical activity and sport.

A rules of procedure adopted by the Assembly shall establish the other functions of the President and Vice-Presidents.

ARTICLE XI . The term of office of the President and of the Vice-Presidents shall be two years, and shall begin at the close of the Ordinary General Assembly in which they are elected.

The quality of President or Vice-President of CONUDE will be lost by:

(a) Voluntary waiver; or

(b) Stop exercising the superior authority of the respective government agency of the sport of your country.

In the event of the office of the Presidency, the first Vice-President will assume it.

ARTICLE XII O The Executive Secretary shall be appointed by the President of the CONSUDE, shall be his sole confidence, and shall perform the following functions:

(a) Support the Presidency for the holding of meetings of the Assembly;

(b) Custody of the CONSUDE documentation;

(c) Maintain executive contact and communication with government sports agencies of member states and other related organizations;

(d) Develop, execute and control the budget allocated to it for the performance of its functions;

(e) Perceive the income of CONSUDE and maintain, bank accounts in conjunction with the President;

(f) To conduct the secretariat of the meetings of assemblies and executive committee of CONSUDE and to make and distribute the relevant records;

(g) Coordinate and support the work of the working commissions;

(h) Collect and disseminate relevant documentation or information;

(i) Renew an annual report on its management in the General Assembly;

(j) Celebrate acts and contracts that are necessary for the operation of CONSUDE; and

(k) Those others which the Assembly or the President expressly entrust to it.

EXECUTIVE COMMITTEE

ARTICLE XIII . The Executive Committee of the CONSUDE will be composed of the President and the Vice-Presidents. The Executive Secretary will integrate it with a right of voice. The functions of the Executive Committee shall be:

(a) Develop and propose to the Assembly a Strategic Plan for a four-year period, an Annual Management Plan and a Budget

(b) Programme compliance with the agreements and resolutions of the Assembly

(c) Determine the call to ordinary and extraordinary assemblies

WORKING COMMISSIONS

ARTICLE XIV . The CONSUDE will have permanent and temporary commissions. There will be two standing commissions: one of Institutional Management and one of Physical Activity and Sports, each chaired by a Vice President.

The temporary commissions will be established by the Executive Committee. The functions and programmes of the working commissions shall be approved by the Executive Committee.

BUDGET

ARTICLE XV . The CONSUDE Budget shall be annual and shall be approved by the General Assembly at regular session.

PATRIMONIO

ARTICLE XVI O The CONSUDE heritage will consist of:

(a) Donations that may be made by other natural and legal persons, whether public or private.

(b) Any other income that in the form of donations, subsidies, aids or otherwise may occur.

SEDE del CONSUDE

ARTICLE XVII . The headquarters of the CONSUDE will be that of the government agency to which the President belongs.

STATUS MODIFICATION

ARTICLE XVIII O The General Assembly may amend the present Statutes by a two-thirds majority of the votes of member States.

DISOLUTION

ARTICLE XIX . The CONSUDE will dissolve when for any reason there is a manifest impossibility of meeting the objectives for which it was created. The dissolution agreement shall be adopted by the favourable vote of three quarters of the General Assembly. The same agreement shall appoint a liquidating commission, whose functioning shall be established by the corresponding Regulations.

VIGENCE OF STATUS

ARTICLE XX . The Statutes shall enter into force thirty days after three signatory States have ratified or acceded through the deposit of the corresponding instrument.

The Statutes of the CONSUDE shall be deposited with the Ministry of Foreign Affairs of the Eastern Republic of Uruguay.

The Government of the Eastern Republic of Uruguay shall inform all Parties of the signatures, ratifications, accessions or complaints received, as well as the date of entry into force of the Statutes.

ARTICLE XXI . Any member State may withdraw from CONSUDE by notification to the depositary, by diplomatic means, with one (1) year in advance.

RECTIFICATION ACT

In the city of Montevideo, on the four days of December of the year two thousand two, the Ministry of Foreign Affairs of the Eastern Republic of Uruguay, in its capacity as depositary of the Treaty for the Creation of the South American Sports Council "Consude", signed in the city of Belém do Pará, Federal Republic of Brazil, on May 4, 2002, in Spanish and Portuguese, HACE CONSTAR:

First: That the Ministry of Foreign Affairs de Treaty Direction de warned of the existence of a dactilographic error in the Spanish version of the International Reference Instrument;

Second: That this error was recorded in the literal (d) of its Considering that it says "That at the Consude meeting held in Lima, Peru, on 26 November 2002...";

Third: That in the above-mentioned paragraph (d) should have said "That at the Consude meeting held in Lima, Peru, on 26 November 2001...";

Fourth: That the above was brought to the attention of the representatives of the signatory countries in accordance with the Vienna Convention on the Law of Treaties.

Fifth: That there is no objection on the part of the respective Governments to the proposed amendment, there is a record of the correction made, and therefore it must be read in the above-mentioned paragraph (d) "...26 November 2001";

To record the actuated, this Act of Rectification is issued in the place and date indicated ut-supra, in Spanish and Portuguese, both texts being equally authentic.
