93. Revocation by the Federal Government of the Federal Constitutional Court on the repeal of the following words in the District Court-Regulation of the Upper Austrian Republic of Austria 2012

In accordance with Art. 139 (5), first sentence B-VG and § 59 (2) of the Constitutional Court Act 1953, BGBl. No. 85/1953, in conjunction with Section 4 (1) Z 4 of the Federal Law Gazette Act, BGBl. I No 100/2003, shall be made known:

The Constitutional Court, with knowledge of 11 March 2014, V 4/2014-17, V 6/2014-9, V 7/2014-11, V 10-14/2014-8, V 16-17/2014-8, V 18 /2014-10, V 19-21/2014-8, V 22-25/2014-5, V 26 /2014-6, V 27-28/2014-5, the Federal Government delivered on 7 April 2014, rightly recognized:

The following provisions of the ordinances of the Federal Government concerning the merger of district courts and the Sprengel of the remaining District Courts in Upper Austria (District Court-Regulation Upper Austria 2012), BGBI. II No 205/2012, are repealed as being illegal:

-§ 1 Z 1, the phrase "partly Freistadt" in § 1 Z 4 and the phrase "partly perg" in § 1 Z 7;

-the municipal names "Bad Leonfelden,", "Haibach im Mühlkreis,", "Ottenschlag im Mühlkreis,", "Reichenau im Mühlkreis,", "Reichenthal,", "Schenkenfelden," and "Zwettl an der Rodl" in § 2 Z 4;

-the municipality names "Bad Zell,", "Königswiesen,", "Pierbach,", "Schönau im Mühlkreis," and "Tragwein" in § 2 Z 10;

-the municipal names "Asten,", "Enns,", "Hargelsberg,", "Hofkirchen im Traunkreis,", "Kronstorf,", "Niederneukirchen," and "St. Florian" in § 2 Z 14.

2. The repeal shall enter into force with the expiry of 30 September 2015.
