275. Ordinance of the Financial Markets Authority (FMA), which changes the FMA Cost Regulation

Pursuant to Section 19 (7) of the Financial Market Supervisory Authority Act-FMABG, BGBl. I n ° 97/2001, as last amended by the Federal Law BGBl. I No 50/2011, shall be assigned:

The FMA-Cost Ordinance-FMA-KVO, BGBl. II No 340/2003, as last amended by the BGBl Regulation. II No 181/2010, shall be amended as follows:

1. In Section 3 (1) (1) (1) (1), the point of reticle shall be replaced by an attic, and the following phrase shall be added: "and subject to costs pursuant to Section 22 (2) of the E-Money Act 2010, which are e-money institutions pursuant to Section 3 (2) of the E-Money Act 2010 or branches pursuant to § 9 E-Money Act 2010;"

2. In § 3 para. 1 Z 3 lit. c will be the phrase "Capital investment companies according to § 2 paragraph 1 InvFG 1993, the services in accordance with § 3 paragraph 2 Z 1 and 2 WAG 2007" through the phrase "Management companies according to § 3 paragraph 2 Z 1 InvFG 2011, the services according to § 5 sec. 2 Z 3 and 4 InvFG 2011" replaced.

3. In § 6 (1) Z 1 the following phrase shall be added: "and § 22 (2) E-Money Act 2010 in conjunction with § 60 sec. 2 ZaDiG,"

4. In § 7 para. 3 Z 4 the word shall be "and" shall be replaced by a dash and in Section 7 (3) Z 5 at the end of the period shall be replaced by a dash and the following Z 6 and 7 shall be added:

" 6.		an e-money institute with a minimum amount in accordance with § 60 (4) of the ZaDiG and
7.		a management company with a minimum amount in accordance with § 144 InvFG 2011 in conjunction with Section 69a (4) of the BWG "

5. The following paragraphs 8 and 9 are added to § 17:

" (8) As far as the provisions of the E-Money Act 2010 are referred to in this Regulation, this is in the version of the Federal Law BGBl. I No 107.

(9) As far as the provisions of the Investment Fund Act 2011 are referred to in this Regulation, this is in the version of the Federal Law BGBl. I No 77. "

6. The following paragraph 7 is added to § 18:

" (7) § 3 para. 1 Z 1 and Z 3 lit. c, § 6 para. 1 Z 1, § 7 para. 3 Z 4, 6 and 7 as well as § 17 para. 8 and 9 in the version of the Ordination BGBl. II No 275/2011 shall enter into force on 1 September 2011. '
