The Chambers adopted and We sanction the following:
Article 1
er. This Act regulates a matter referred to in Article 74 of the Constitution.
Art. 2. In section 4 of the Act of 31 January 2003 on the phase-out of nuclear energy for industrial electricity production, replaced by the Act of 18 December 2013, the following amendments are made:
1° paragraph 1
er is replaced by the following:
§ 1
er. The Doel 1 nuclear power plant can again produce electricity from the entry into force of the Act of 28 June 2015 amending the Act of 31 January 2003 on the phase-out of nuclear energy for industrial electricity production in order to ensure the security of energy supply. It is disabled and can no longer produce electricity from February 15, 2025. Other nuclear power plants intended for industrial electricity production from the fission of nuclear fuels are deactivated on the following dates and can no longer produce electricity from these dates:
- Doel 3: 1
er October 2022;
- Tihange 2:
er February 2023;
- Doel 4: 1
er July 2025;
- Tihange 3: 1
er September 2025;
- Tihange 1:
er October 2025;
- Doel 2:
er December 2025. ".
2° the article is supplemented by a paragraph 3, which reads as follows:
§ 3. The King advances, by order deliberately in the Council of Ministers, the date referred to in § 1
er for nuclear power plants of Doel 1 and Doel 2 to 31 March 2016, if the convention referred to in Article 4/2, § 3, is not entered into by 30 November 2015. ".
Art. 3. In Chapter 2 of the Act, amended by the Act of 18 December 2013, an article 4/2 is inserted as follows:
"Art. 4/2. § 1
er. The owner of the Doel 1 and Doel 2 nuclear power plants pays to the federal state until 15 February 2025 for Doel 1 and until 1
er December 2025 for Doel 2, an annual fee for the extension of permission for industrial electricity production from the fission of nuclear fuels.
§ 2. The royalty referred to in § 1
erexcludes any other charges in favour of the federal state (with the exception of general application taxes) that would be related to the ownership or operation of nuclear power plants Doel 1 and Doel 2, the revenues, production or capacity of production or the use by nuclear fuel.
§ 3. The federal state concludes a convention with the owner of the Doel 1 and Doel 2 nuclear power plants in particular with a view to:
1° specify the procedure for calculating the royalty referred to in paragraph 1
er;
2° to pay compensation for each of the parties in the event of non-compliance with their contractual obligations. ".
Art. 4. This Act comes into force on the day of its publication in the Belgian Monitor
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
