21 DECEMBER 2013. - An Act to approve the Agreement, concluded by exchange of notes verbales dated 16 October 2013 and 7 November 2013, extending the agreement between the Kingdom of Belgium and the Kingdom of the Netherlands on the provision of a penitentiary facility in the Netherlands for the enforcement of custodial sentences imposed under Belgian convictions, made in Tilburg, the Netherlands, on 31 October 2009 (1). - Addendum

The Embassy of the Kingdom of the Netherlands presents its compliments to the Federal Public Service Foreign Affairs of the Kingdom of Belgium and has the honour to propose to extend for a period of one year the Convention made in Tilburg on 31 October 2009 between the Kingdom of the Netherlands and the Kingdom of Belgium on the provision of a penitentiary institution in the Netherlands for the execution of custodial sentences imposed under Belgian condemnations, which ceases 31 December 2013. The agreement will remain in effect until December 31, 2014 inclusive.
The Embassy also has the honour to propose that the Ministers of Justice of the host State and the State of origin:
- can be agreed on 1er July 2014 at the latest that the penitentiary institution remains at the disposal of the State of origin also after December 31, 2014 until December 31, 2015 at the latest;
- can be agreed on 1er July 2015 at the latest that the penitentiary institution remains at the disposal of the State of origin also after December 31, 2015 until December 31, 2016 at the latest. The agreement will therefore remain in effect, respectively, until December 31, 2015 and December 31, 2016 inclusive.
Finally, the Embassy has the honour to propose that the annual indexing for the year 2014 (and the years 2015 and 2016 if applicable) is carried out in accordance with Article 29, paragraph 3, of the Convention and according to the following schedule:
- 1er January 2014 for the years 2009 to 2013;
- 1er January 2015 (if applicable), for the years 2010 to 2014;
- 1er January 2016 (if applicable), for the years 2011 to 2015.
If the foregoing is acceptable to the Government of the Kingdom of Belgium, the Embassy has the honour to propose that this note and the response note of the Federal Public Service together constitute a convention between the Kingdom of the Netherlands and the Kingdom of Belgium, which will come into force on the date of receipt by the Kingdom of the Netherlands of the notification of the Kingdom of Belgium that it is satisfied with the national legal requirements for the entry into force of the Convention, and that will have effect on 31

The Federal Public Service has the honour to communicate to the Embassy that the Government of the Kingdom of Belgium accepts the proposal as contained in the above-mentioned note of the Embassy and that the note of the Embassy and this response note will together constitute a convention between the Kingdom of the Netherlands and the Kingdom of Belgium, which will enter into force on the date of receipt by the Kingdom of the Netherlands of the notification of the Kingdom of Belgium that it is satisfied with the legal requirements
