14 JANVIER 2013. - An Act to amend the Civil Protection Act of December 31, 1963 (1)

ALBERT II, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1^er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. In section 10 of the Civil Protection Act of December 31, 1963, replaced by the Act of July 20, 2005, the following amendments are made:
1° in § 2, 2°, paragraph 1^er(a) and (b) are replaced by the following:
“(a) the overall cadastral income of each commune as at 1^er January of the year in which the fees were exposed;
(b) the population of each commune as at 1^er January of the year in which the fees were exposed, as a result of the last official population survey published in the Belgian Monitor; »;
2° § 2, 3°, is repealed;
3° in § 2, 4°, paragraph 1^er and 5°, paragraph 1^er, the words "points 2° and 3°" are replaced by the words "point 2°";
4° in § 2, 4°, paragraph 3 is repealed;
5° § 3, paragraph 1^er, is supplemented by the words: "with regard, mainly, of the population and the cadastral income. »;
6° in § 3, paragraph 2, the words "in the sixty days" are inserted between the words "the governor decides" and the words "and notifies his decision to the communal council";
7° in § 3, paragraph 3 is repealed;
8° in § 4, 2°, paragraph 1^er, the words "taking as a basis the final fee paid for the previous year" are replaced by the words "taking as a basis the last final fee paid";
9° in § 4, 3°, paragraph 4, the words "in the sixty days" are inserted between the words "the governor statue" and the words "and notifies his decision to the communal council";
10° in § 5, the words "3°, paragraph 2," are repealed.
Art. 3. Section 11, paragraph 3, of the Act, replaced by the Act of 15 January 1999, is supplemented by the following sentence:
"This requisition takes place within sixty days after the day on which the decision setting the due amount has become final. »
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.
