13 DECEMBER 2010. - An Act to amend sections 2, 2/1, 4 and 5 of the Act to amend the Act of 17 January 2003 concerning the appeals and processing of disputes on the occasion of the Act of 17 January 2003 relating to the status of the regulator of the Belgian postal and telecommunications sectors (1)

To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
Art. 2. In section 2 of the Act of 17 January 2003 concerning the appeals and processing of disputes on the occasion of the Act of 17 January 2003 relating to the status of the regulator of the Belgian postal and telecommunications sectors, as amended by the Act of 20 July 2006 and replaced by the Act of 31 May 2009, the following amendments are made:
1° the words "the Minister who has the Telecommunications in his powers" are replaced by § 1er, paragraph 3, and paragraph 2, paragraphs 3 and 7, by the words "the Minister who has the Telecommunications in his powers or the Minister who has the Postal Sector in his powers";
2° in § 2, paragraph 2, 2°, of the same article, the word "Minister" is replaced by the words "Minister who has the Telecommunications in his powers or the Minister who has the Postal Sector in his powers".
Art. 3. In section 2/1 of the same Act, inserted by the Act of 31 May 2009, the words "Minister who has the Telecommunications in his powers" are replaced by the words "Minister who has the Telecommunications in his powers or the Minister who has the Postal Sector in his powers".
Art. 4. Article 4, paragraph 1er, of the same law, as amended by the Act of 20 July 2006, the words "between postal operators relating to the implementation of the provisions contained in their licence" are replaced by the words "between postal service providers relating to the implementation of the provisions contained in their licence and concerning access to postal infrastructure elements or services that are offered within the framework of the universal service that are necessary for the execution of postal activities".
Art. 5. Article 5 of the Act is supplemented by a § 3, which reads as follows:
“§3. All obligations in this Act and in all other laws relating to the substances referred to in Article 77 of the Constitution and their enforcement orders which, in respect of recommended consignments, contain the words "to the post", "by mail" or any other reference of the same type shall be fulfilled when a recommended consignment as defined in Article 131, 9° of the Act of 21 March 1991 relating to the reform of certain economic public enterprises is used or when »
Art. 6. Within twenty-four months after the coming into force of this Act, the King may repeal in all legal and regulatory provisions relating to the matters referred to in Article 77 of the Constitution and their enforcement orders concerning the recommended consignments the words "to the post", "by mail" or any other reference of the same type.
Art. 7. This Act comes into force on December 31, 2010.
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.
