Law amending the Law on Bulgarian identity documents (prom. § 1. The name of the law is amended as follows: "law on Bulgarian identity documents."
§ 2. The title of Chapter I is amended as follows: "Bulgarian identity documents."
§ 3. In art. 1 made the following amendments:
1. In para. 1, 'Bulgarian identity documents "are replaced by" Bulgarian identity documents. "
2. In para. 2 words "Bulgarian identity documents" are replaced by "Bulgarian identity documents" and the words "Ministry of Transport" are replaced by "the Ministry of Transport, Information Technologies and Communications." 3
. Paragraph 3 is amended as follows:
"(3) The refusal of a Bulgarian identity documents, the revocation and the imposition of other limitations associated with their use and storage shall be determined by law."
4. In para. 4 words "Bulgarian identity documents" are replaced by "Bulgarian identity documents."
5. A par. 5:
"(5) The Bulgarian identity documents for the purposes of this Act are:
1. identity documents;
2. driving a motor vehicle; 3
. residence documents. "
§ 4. In art. 2 words "Bulgarian identity documents" are replaced by "Bulgarian identity documents."
§ 5. Article 3 shall be amended as follows:
"Art. 3. (1) identification documents establishing identity and if necessary - and citizenship, by information contained in them.
(2) The identity of the Bulgarian citizens can be certified by substituting documents or other documents in order and in the cases determined by law.
(3) The certificate of driving a motor vehicle shall certify the competence to drive a motor vehicle and for Bulgarian citizens - and the identity of the Republic of Bulgaria through it contains data.
(4) residence documents certifying only the right of residence in the Republic of Bulgaria. "
§ 6. In art. 4 made the following amendments:
1. Paragraph 2 is amended as follows:
"(2) An alien residing in the Republic of Bulgaria has the right to an identity document or residence document and driving a motor vehicle in the cases determined by law. "
2. A new paragraph. 3:
"(3) Citizens of the European Union (EU) citizens of countries - parties to the Agreement on the European Economic Area (EEA) citizens of Switzerland and their family members who are not EU citizens, EEA and the Swiss Confederation, by virtue of international treaties with the EU are entitled to free movement are entitled to a residence permit and driving a motor vehicle issued in the Republic of Bulgaria under the terms and in the cases determined by law. "| || 3. Former para. 3 becomes para. 4 and the words "Bulgarian identity document" are replaced by "Bulgarian identity document".
§ 7. Article 5 is amended as follows:
"Art. 5. For issuance of Bulgarian identity documents the persons under Art. 4 appear before the appropriate authority under Art. 1, para. 2 cases and procedures specified in this Act. "
§ 8. In art. 7 is amended as follows:
1. In para. 1, 'Bulgarian identity documents "are replaced by" Bulgarian identity documents. "
2. In para. 2 words "identity document" are replaced by "personal document".
§ 9. In art. 8 is amended as follows:
1. In para. 1 the words "identification documents" are replaced by "Bulgarian identity documents."
2. Paragraphs 2 and 3 are amended as follows:
"(2) In case of loss, theft, damage or destruction of Bulgarian identity document holder shall be obligated within three days to notify the nearest structural unit of the Ministry of Interior in diplomatic or consular representations of the Republic of Bulgaria abroad and in the cases of art. 39a - the Ministry of Defence or in diplomatic and consular missions of the Republic of Bulgaria abroad.
(3) In case of loss, theft, damage or destruction of Bulgarian identity document face within three days may submit a declaration on these circumstances electronically in an order determined by the Council of Ministers. "
3. In para. 4 the word "application" is replaced by "declaration".
§ 10. Article 9 is amended as follows:
"Art. 9. (1) Where the names, personal identification number (personal number / personal number of foreigner), gender, nationality or substantial and permanent changes of the image the person is obliged to submit an application for a new Bulgarian identity documents within to 30 days.
(2) In the period under par. 1 in case of permanent address person is obliged to submit an application for a new ID card, residence permit under Art. 59 para. 2 pt. 2 and 4, refugee card, a map of a foreigner granted asylum, and a map of a foreigner with humanitarian status. Upon a change of domicile from one locality to another settlement within 30 days of issuing the new document the person is obliged to apply for a new driving a motor vehicle.
(3) Upon issuance of the new Bulgarian personal documents Earlier the same type returned to the body that issued it. "
§ 11. In art. 10 be made the following amendments:
1. The previous text becomes para. 1 and in it:
a) in the text before item. 1, 'Bulgarian identity documents "are replaced by" Bulgarian identity documents ";
B) in item. 2 after the word "nationality" insert "except for driving a motor vehicle";
In) the item. 5:
"5. expiry of their validity. "
2. A par. 2:
"(2) Returned Bulgarian personal documents be destroyed. The modalities for disposal shall be governed by instructions to the relevant authority under Art. 1, para. 2. "
§ 12. In art. 11 words "Bulgarian identity document" are replaced by "Bulgarian identity document".
§ 13. In the first chapter the title of Section II shall be amended as follows: "Types of Bulgarian identity documents."
§ 14. In art. 13 para. 2 pt. 2 words "border pass" are replaced by "official open sheet crossing the border."
§ 15. Article 14 is amended as follows:
"Art. 14. (1) A resident in the Republic of Bulgaria foreigners issued the following IDs:
1. refugee card;
2. Card of a foreigner granted asylum; 3
. Card of a foreigner with humanitarian status;
4. Temporary card of a foreigner;
5. certificate for traveling abroad of refugee;
6. certificate for traveling abroad of a foreigner granted asylum;
7. certificate for traveling abroad of a foreigner with humanitarian status;
8. certificate for traveling abroad for a person without citizenship;
9. temporary certificate for leaving the Republic of Bulgaria;
10. certificate for return to the Republic of Bulgaria to a foreigner.
(2) resident in the Republic of Bulgaria foreigners who have obtained a residence permit under the Law on Foreigners in the Republic of Bulgaria shall be issued residence documents - a residence permit in accordance with Regulation (EC) № 1030/2002 of the Council of 13 June 2002 on a uniform format for residence permits for third-country nationals, hereinafter "Regulation (EC) № 1030/2002".
(3) resident in the Republic of Bulgaria family members of EU citizens, family members of citizens of the countries - parties to the EEA family members of citizens of the Swiss Confederation, who are not citizens of the EU, EEA and the Swiss Confederation, by virtue of international treaties with the EU have exercised their right to free movement under the terms and procedure of the entry, stay and departure from the Republic of Bulgaria to the European Union citizens and their family members are issued documents residence - a residence permit with the remark "card, exercised his right to free movement."
(4) EU citizens, citizens of countries - parties to the EEA Agreement, citizens of the Swiss Confederation who reside in the Republic of Bulgaria under the terms and procedure of the entry, stay and departure from the Republic of Bulgaria European Union citizens and their family members are issued a certificate of residence of the EU citizen.

§ 16. In the first chapter the title of Section III is amended as follows:" data on Bulgarian identity documents. "
§ 17. In art. 16 be made the following amendments:
1. In para. 1:
a) in the text before item. 1, 'Bulgarian identity documents "are replaced by" Bulgarian identity documents ";
B) in item. 3, 'or personal number of foreigner "are replaced by" private and personal number to a stranger. "
2. In para. 2 after the word "status" is added "military identity card, residence permit under Art. 59 para. 2 ". 3
. Paragraph 3 is amended as follows:
"(3) The names of the data in the Bulgarian identity documents shall be written in Bulgarian and English. In the presence of obligations under international instruments names of the data can be written in French. "
4. A par. 5:
"(5) personal number uniquely identifies EU citizens, citizens of countries - parties to the EEA Agreement, citizens of Switzerland and their family members who are not citizens of the EU, EEA and Swiss Confederation under of international treaties with the EU are entitled to free movement. The manner of its formation is determined by the Cabinet. "
§ 18. In art. 17 be made the following amendments:
1. In para. 1, 'Bulgarian identity documents "are replaced by" Bulgarian identity documents. "
2. Created al. 4, 5 and 6:
"(4) Do not take biometric data - fingerprints of children under the age of 12 and people with physical inability to give fingerprints. Do not take biometric data - fingerprints of children under 6 years of age and persons with physical inability to give fingerprints when submitting applications for residence documents under Art. 59 para. 2 and 3.
(5) The person may not appear in person to submit an application for issuance of Bulgarian identity documents when:
1. no change of the name, personal identification number (ID number or the personal number of foreigner), gender, nationality or not there have been significant and permanent changes to the image of the person and
2. It has taken the necessary biometric data of up to two years from the date of application; 3
. It is provided by law.
(6) Bulgarian identity document shall be received personally, and except where the application has been submitted in person - by an authorized person upon presentation of a notarized power of attorney. "
§ 19. Article 18 is amended as follows: || | "Art. 18. (1) The application for issuance of identity documents of Bulgarian citizens contain the following data:
1. names;
2. date of birth; 3
. place of birth;
4. sex;
5. identification number;
6. presence of another nationality;
7. eye color;
8. growth;
9. permanent address;
10. marital status;
11. telephone number.
(2) An application for a residence documents under Art. 59 para. 2 and 3 contain the following data:
1. names;
2. date of birth; 3
. place of birth;
4. sex;
5. personal identification number (personal ID number or personal number of foreigner);
6. citizenship;
7. changed names;
8. presence of another nationality;
9. permanent address;
10. current address (address);
11. education;
12. marital status;
13. phone connection;
14. No other identity document or residence permit.
(3) Applications for residence documents under Art. 59 para. 4 contains the following data:
1. names;
2. date of birth; 3
. place of birth;
4. sex;
5. personal number;
6. citizenship;
7. changed names;
8. presence of another nationality;
9. address;
10. number of national identification document;
11. education;
12. marital status;
13. telephone number.
(4) Applications for issuance of identity documents to foreigners contain the following data:
1. names;
2. date of birth; 3
. place of birth;
4. sex;
5. personal identification number (personal ID number or personal number of foreigner);
6. citizenship;
7. changed names;
8. presence of another nationality;
9. eye color;
10. growth;
11. special characteristics;
12. permanent address;
13. current address (address);
14. education;
15. workplace;
16. marital status;
17. phone connection;
18. number (s) of other identity document if the person was issued one and the previous ID.
(5) Applications for driving a motor vehicle foreigners contain the following data:
1. names;
2. date of birth; 3
. place of birth;
4. sex;
5. personal identification number (personal ID number or personal number of foreigner);
6. citizenship;
7. permanent address;
8. current address (address);
9. phone connection;
10. number (s) of other identity document or residence document if the person has issued such. "
§ 20. In art. 18a is amended as follows:
1. Paragraph 1 shall be amended as follows:
"(1) An application for issuance of Bulgarian identity documents may be filed electronically with the terms and conditions set by the Council of Ministers where:
1. the person was issued a Bulgarian identity document application submitted in person up to two years before the date of application for a new document;
2. the person holds a valid certificate for universal electronic signature; 3
. the person have taken the necessary biometric data. "
2. Paragraph 3 is amended as follows:
"(3) not allowed an application for issuance of Bulgarian identity document electronically in a name change, personal identification number (ID number or the personal number of foreigner), gender, nationality or in substantial and permanent changes of the image of the person. "
third. Paragraph 5 shall be amended as follows:
"(5) Where the application for issuance of Bulgarian identity document is submitted electronically, the document is received personally."
§ 21. A Art. 18b:
"Art. 18b. The modalities for the storage and destruction of applications based on the issued Bulgarian identity documents shall be determined by the Council of Ministers. "
§ 22. In art. 19 is amended as follows:
1. In para. 1, 'Bulgarian identity documents "are replaced by" Bulgarian identity documents. "
2. In para. 2 words "Bulgarian identity documents" are replaced by "Bulgarian identity documents." 3
. Paragraph 3 is amended as follows:
"(3) Bulgarian identity documents the names of Bulgarian citizens are written without abbreviations as they are written in the submitted supporting documents except in cases where their length exceeds that provided technical ability."
§ 23. In art . 20 be made the following amendments:
1. In para. 1, 'Bulgarian identity documents "are replaced by" Bulgarian identity documents. "
2. In para. 2:
a) in the text before item. 1, 'Bulgarian identity documents "are replaced by" Bulgarian identity documents ";
B) pt. 9, after the words "UCC" a comma and add "private number". 3
. In para. 3 words "identity document" are replaced by "Bulgarian identity document".
4. In para. 4 finally added "and the documents under Art. 14, para. 5 ".
§ 24. In art. 20a be made the following amendments:
1. In para. 1 after the words "humanitarian status" a comma and added "military identity cards and residence documents under Art. 59 para. 2 and 3 ".
2. Paragraph 2 is amended as follows:
"(2) The electronic media shall contain the data under Art. 20, para. 2 photograph of the person, his fingerprints and signature recorded at the application and place of birth, written in Latin, and the names of the person written in Cyrillic. "
Third. A new paragraph. 3:
"(3) residence documents under Art. 59 para. 3 provides an electronic medium of information that are stored facial image and data of art. 20, para. 2. "
4. Former para. 3 becomes para. 4.
5. A par. 5:
"(5) In cases where the electronic media data available for reading disability, if the person is issued a new document under par. 1 the validity of the damaged document. "
§ 25. Article 21 is amended as follows:
" Art. 21. (1) The names of foreigners in Bulgarian identity documents are displayed in the order and number as written in travel documents with which they entered the Republic of Bulgaria. When foreigners granted asylum, refugee status or humanitarian status do not have such documents, their names are displayed in the order in which they indicate in the declaration signed by them before the competent authority. In Bulgarian identity documents the names of persons are written without abbreviations as they are written in the submitted supporting documents except in cases where their length exceeds that provided technical possibility.
(2) The names of the persons under par. 1 Bulgarian identity documents are written by Bulgarian transcription according to rules approved by the Council of Ministers. "
§ 26. In art. 22, para. 1 is amended as follows:
1. In the text before item. 1, 'Bulgarian identity documents "are replaced by" Bulgarian identity documents. "
2. In item. 3 the words "25 mm and 35 mm" are replaced by "31.5 mm and 36 mm."
§ 27. In art. 26 is amended as follows:
1. In para. 1 p. 11 is canceled.
2. Paragraph 2 is amended as follows:
"(2) An application for an identity card besides the data under Art. 18, para. 1 contains data:
1. parents (names, date of birth);
2. husband / wife (name, identification number, personal number / personal number of foreigner); 3
. legal representative (names, identification number, personal number / personal number of foreigner identity card number, date of issue, authority that issued it);
4. Decree of the President of the Republic of Bulgaria for change of nationality. "
§ 28. Article 31 is amended as follows:
" Art. 31. (1) Personal Cards are issued and replaced by the Ministry of Interior at the permanent address of the person upon presentation of an application and documents in civil status issued by the local administration in the order established by the Council of Ministers.
(2) In cases where the identity card has expired, damaged, destroyed, lost or stolen, the person is required within 30 days to apply for a new ID card.
(3) At the request of the person a new identity card can be issued before the expiry of its validity.
(4) Personal cards are issued within 30 days from the date of application.
(5) Where the application for issuance of identity card is submitted in diplomatic or consular representations abroad, the deadline for issuing up to 90 days. "
§ 29. A Art. 31a:
"Art. 31a. (1) The application for issuance of identity cards shall be submitted in person.
(2) The application for issuance of identity cards to minors and persons under legal disability shall be submitted personally in the presence of a parent, guardian or custodian that signature in the application.
(3) In cases where the child is unknown or deceased parents or other legal representatives or not appointed trustee, and in cases where at the time of completion of 14 years of age parents or legal representatives not appeared to lay the signature in the application:
1. application for issuance of identity cards to minors, put in a specialized institutions shall be submitted personally in the presence of the director of the specialized institution in which the child is placed in the appropriate order that signature in the application;
2. application for issuance of identity cards to minors placed a judgment in foster family shall be submitted personally in the presence of host parent signature in the application;
3
. application for issuance of identity cards to minors placed a judgment about growing up in a family of relatives or friends, be submitted personally in the presence of a close relative or with whom the minor is admitted that signature in the application.
(4) The identity card is received in person, and except where the application has been submitted in person - by an authorized person upon presentation of a notarized power of attorney or by a person whose data are given by the applicant to the official in the application when submitting his.
(5) identity cards to minors and persons under legal disability is derived from a parent, guardian or custodian, and exceptionally - by an authorized person upon presentation of a notarized power of attorney or by a person whose data are given by a parent, guardian to the official in the application in its submission.
(6) identity cards to minors issued on an application filed under par. 3 gave the person have signed the application. "
§ 30. In art. 36 be made the following amendments:
1. In para. 2 the words "Ministry of Transport" are replaced by "the Ministry of Transport, Information Technologies and Communications."
2. A new paragraph. 3:
"(3) In cases where it is impossible collection of biometric data - fingerprints, face due to temporary physical impossibility, may be issued a passport valid for 12 months."
Third. Former para. 3 and 4 shall become par. 4 and 5.
§ 31. In art. 38, para. 1, p. 4 the words "State Inspectorate of Shipping of seafarers" are replaced by "the Ministry of Transport, Information Technologies and Communications."
§ 32. In art. 39 made the following amendments:
1. In item. 1 after the words "12 months" is added "consistent with the time needed to return to Bulgaria".
2. Point 2 is amended as follows:
"2. official open sheet border crossing - issued by the Ministry of Interior to persons, valid and may be extended in accordance with international treaties; ".
§ 33. In art. 41 is amended as follows:
1. In para. 1 p. 3 is repealed.
2. Paragraph 2 is repealed. 3
. Paragraph 3 is amended as follows:
"(3) The application for issuance of passports and substituting documents, besides the data under Art. 18, para. 1 contains data:
1. parents (names, date of birth);
2. husband / wife (name, identification number, personal number / personal number of foreigner); 3
. legal representative (names, personal identification number, identity card number, date of issue, issuing authority of issue);
4. Decree of the President of the Republic of Bulgaria for change of nationality. "
§ 34. In art. 41a creates pt. 9:
"9. biometrics. "
§ 35. In art. 44 para. 3 is amended as follows:
"(3) Passport or substituting document is received in person, and except where the application has been submitted in person - by an authorized person upon presentation of a notarized power of attorney or by a person whose data are given by the applicant to the official the application in its submission. "
§ 36. in art. 45 made the following amendments:
1. The previous text becomes para. 1.
2. A par. 2:
"(2) Passport or substitute document of minors and persons under legal disability is derived from a parent, guardian, custodian or person authorized by them after submission of notarized power of attorney or by a person whose data are given by a parent, guardian or custodian to the official in the application in its submission. "
§ 37. in art. 49 be made the following amendments:
1. In para. 1:
a) in the text before item. 1 after the word "passport" insert "or substituting documents";
B) in item. 2 after the word "passport" insert "or substituting document";
C) in item. 3 after the word "passport" insert "or substitute document."
2. Paragraphs 2 and 3 are amended as follows:
"(2) The invalidity of the documents under par. 1 is declared by the authority that issued them.
(3) Persons are required to return their passports and substituting documents to the authority which issued them within three months after the expiry of their validity or the grounds for their issuance or use. "
§ 38. In art. 50 para. 2 is amended as follows:
"(2) The certificate of driving a motor vehicle serves as an identification document of Bulgarian citizens in the Republic of Bulgaria."
§ 39. In art. 53 be made the following amendments:
1. In para. 1 created item. 12:
"12. emblem of the model of the European Community for driving a motor vehicle containing the distinguishing mark of the Republic of Bulgaria. "
2. Paragraph 2 is repealed.
§ 40. The title of Chapter V is amended as follows: "Bulgarian identity documents issued to resident foreigners in Bulgaria."
§ 41. Article 55 is amended as follows:
"Art. 55. (1) Every foreigner granted asylum, refugee status or humanitarian status under the terms and provisions of the Law on Asylum and Refugees, issued Bulgarian identity document.
(2) Any person under par. 1 is required after the age of 14 years old within 30 days to apply for an identity document under Art. 14, para. 1, p. 1, 2 and 3.
(3) Every foreigner who is allowed to reside in the Republic of Bulgaria under the terms and provisions of the Law on Foreigners in the Republic of Bulgaria for a period greater than three months shall be issued a residence permit in accordance with Regulation (EC) № 1030/2002.
(4) family members of EU citizens, the members of the families of citizens of the countries - parties to the EEA Agreement, the members of the families of citizens of the Swiss Confederation, who are not citizens of the EU, EEA and Swiss Switzerland under international treaties with the EU are entitled to free movement shall be issued a residence permit under the terms and procedure of the entry, stay and departure from the Republic of Bulgaria to the European Union citizens and their family members.
(5) EU citizens, citizens of countries - parties to the EEA Agreement, citizens of the Swiss Confederation, by virtue of international treaties with the EU are entitled to free movement shall be issued residence certificate subject and the Law on entry, stay and departure from the Republic of Bulgaria to the European Union citizens and their family members.

§ 42. In art. 57 para. 1 is amended as follows:
"(1) Foreigners authorized stay in the Republic of Bulgaria under the terms and provisions of the Law on Foreigners in the Republic of Bulgaria, identify themselves with a national travel document and certify their right of residence residence permit in accordance with Regulation (EC) № 1030/2002. "
§ 43. In Chapter five title of section II shall be amended as follows:" Types of identity documents of foreigners and residence documents. "
§ 44. Article 59 is amended as follows:
"Art. 59. (1) A resident in the Republic of Bulgaria foreigners issued the following IDs:
1. refugee card - issued by the Ministry of Interior of a person with refugee status valid for up to 5 years;
2. Card of a foreigner granted asylum - issued by the Ministry of Interior of the person who is granted asylum valid for 5 years; 3
. Card of a foreigner with humanitarian status - issued by the Ministry of Interior to a foreigner with humanitarian status, valid for three years;
4. Temporary card of a foreigner - issued by the Ministry of Interior to foreigners whose national identification documents were seized in the cases provided by law;
5. certificate for traveling abroad of refugee - issued by the Ministry of Interior to a foreigner with refugee status valid for up to five years but not more than the validity of the refugee card;
6. certificate for traveling abroad of a foreigner granted asylum - issued by the Ministry of Interior to a foreigner granted asylum valid for 5 years but not more than the duration of a map of a foreigner granted asylum;
7. certificate for traveling abroad of a foreigner with humanitarian status - issued by the Ministry of Interior to a foreigner with humanitarian status valid for up to three years but not more than the validity of the card of foreigner with humanitarian status ;
8. certificate for traveling abroad for a person without citizenship - issued by the Ministry of Interior to foreigners who have the status of a person without citizenship and permanent residence permits in the Republic of Bulgaria;
9. temporary certificate for leaving the Republic of Bulgaria - issued by the Ministry of Foreign Affairs.
(2) resident in the Republic of Bulgaria foreigners issued the following residence documents:
1. residence permit continuously residing in the Republic of Bulgaria to a foreigner - issued by the Ministry of Interior valid for up to one year;
2. residence permit for permanent residence in the Republic of Bulgaria - issued by the Ministry of Interior for a period depending on the validity of the national identity document with which the person has entered the Republic of Bulgaria; 3
. residence permit long resident family member of an EU citizen who has not exercised his right to free movement, marked "family member" - issued by the Ministry of Interior valid for 5 years;
4. residence permit for a resident family member of an EU citizen who has not exercised his right to free movement, marked "family member" - issued by the Ministry of Interior valid for 10 years;
5. Residence Permit for a continuously staying with indication "beneficiary pursuant to Article 3 paragraph 2 of Directive 2004/38 / EC" - issued by the Ministry of Interior valid for 5 years;
6. residence permit for permanent residence with a reference to "beneficiary under Article 3, paragraph 2 of Directive 2004/38 / EC" - issued by the Ministry of Interior valid for 10 years.
(3) family members of EU citizens, the members of the families of citizens of the countries - parties to the EEA Agreement, citizens of the Swiss Confederation, who are not citizens of the EU, EEA and Swiss Confederation in virtue of international treaties with the EU are entitled to free movement shall be issued the following residence documents:
1. residence permit long resident family member of an EU citizen who has exercised his right to free movement, with the words "map exercised his right to free movement" - issued by the Ministry of Interior valid until Five years;
2. residence permit for a resident family member of an EU citizen who has exercised his right to free movement, with the words "map exercised his right to free movement" - issued by the Ministry of Interior valid until 10 years.
(4) EU citizens, citizens of countries - parties to the EEA Agreement, citizens of the Swiss Confederation, by virtue of international treaties with the EU are entitled to free movement must issue these certificates residence:
1. for long stay - issued by the Ministry of Interior valid for 5 years;
2. permanent residence - issued by the Ministry of Interior valid for 10 years.
(5) employee in a diplomatic or consular representation or international organization accredited in the Republic of Bulgaria shall be issued the following types of cards from the Ministry of Foreign Affairs with validity depending on the term of accreditation:
1. diplomatic card;
2. Consular card; 3
. map of administrative and technical personnel;
4. map of staff.
(6) The certificate of return to the Republic of Bulgaria to a foreigner shall be issued by diplomatic and consular representations of a stateless person or a foreigner granted asylum in the Republic of Bulgaria lost abroad his Bulgarian identity document under par. 1, p. 3, 4, 7 and 8. The same document is issued to a foreigner under Art. 34, para. 7 of the Law on Asylum and Refugees when not in possession of valid national documents for travel. "
§ 45. Article 60 is repealed.

§ 47. Article 61 is amended as follows:

. growth;
4. eye color;
5. permanent address;
6. signature of the holder;
7. document number;
8. date of issue;
9. date of expiry;
10. issuing authority;
11. number of national travel document;
12. other data provided by law.
(2) identification documents to foreigners under Art. 59 para. 1, p. 5-9 besides the data under Art. 16 para. 1 containing the following data:
1. photograph of the holder;
2. place of birth; 3
. signature of the holder;
4. document number;
5. date of issue;
6. date of expiry;
7. issuing authority;
8. other data provided by law. "
§ 48. A Art. 61a:
"Art. 61a. (1) residence documents under Art. 59 para. 2 and 3, besides the data under Art. 16 para. 1 containing the following data:
1. photograph of the holder;
2. place of birth; 3
. document number;
4. address;
5. signature of the holder;
6. date of issue;
7. date of expiry;
8. issuing authority;
9. number of national travel document;
10. other data provided for in Regulation (EC) № 1030/2002.
(2) residence documents under Art. 59 para. 4 besides the data under Art. 16 para. 1 containing the following data:
1. photograph of the holder;
2. address; 3
. document number;
4. signature of the holder;
5. date and place of issue;
6. date of expiry;
7. issuing authority.
(3) residence documents under Art. 59 para. 5 besides the data under Art. 16 para. 1, p. 1, 2, 4 and 5 contain the following information:
1. photograph of the holder;
2. signature of the holder; 3
. document number;
4. date of issue;
5. date of expiry;
6. issuing authority;
7. signed by the Director of State Protocol;
8. diplomatic or consular mission or international organization to which he is accredited employee;
9. diplomatic rank or position.
(4) residence documents entered address as:
1. under Art. 59 para. 2 pt. 1 and 3 entered this address;
2. under Art. 59 para. 2 pt. 2 and 4 fits permanent address.
(5) residence documents under Art. 59 para. 2 pt. 5 and 6, para. 3 and 4 are recorded address in the Republic of Bulgaria, of which the person resides. "
§ 49. In art. 62 para. 1 is amended as follows:
"(1) Identity document of a foreigner or a residence permit is issued on application to the respective body and presented national travel document with which the person has entered the country."
§ 50. Article 63 is amended as follows:
"Art. 63. An application for an identity document of the foreigner and residence permits for a foreigner unless the relevant data under Art. 18, para. 2 and 4 contain data for:
1. parents (names, date of birth, citizenship and personal number of foreigner);
2. brothers and sisters (names, date of birth, citizenship and personal number of foreigner); 3
. husband / wife (name, date of birth, citizenship and personal number of foreigner was / were you a Bulgarian citizen and when, present place of residence at the time);
4. children under 14 years (name, date of birth, citizenship and personal number of foreigner);
5. legal representative (names, date of birth, citizenship and personal number of foreigner);
6. Decree of the President of the Republic of Bulgaria for change of nationality;

17. has the person been Bulgarian citizen, when and under what name;
18. accompanying persons under 14 years listed in the passport of whom the person has parental or guardianship rights (name, nationality, date of birth, place of birth, addresses, personal phone numbers);
19. previous stay in the Republic of Bulgaria (when, for how long, addresses);
20. other circumstances and documents provided by law. "
§ 51. A Art. 63a:
"Art. 63a. (1) refugee card, the card of a foreigner granted asylum, and the card of foreigner with humanitarian status is issued and replaced by the Ministry of Interior at the permanent address of the person.
(2) Where the document under par. 1 has expired, damaged, destroyed, lost or stolen, the person is required within 30 days to submit an application for a new one.
(3) The application for issuing documents under par. 1 shall be submitted in person.
(4) The application for issuance of documents under par. 1 of minors and persons under legal disability shall be submitted personally in the presence of a parent, guardian or custodian that signature in the application.
(5) The application for issuance of documents under par. 1 of minors, put in a specialized institutions shall be submitted personally in the presence of the director of the specialized institution in which the child is placed in the appropriate order, only in cases where the child is unknown or deceased parents or other legal representatives or which is not appointed trustee, and in cases where at the time of completion of 14 years of age parents or legal representatives had not appeared to lay the signature in the application. "
§ 52. a Art. 63b:
"Art. 63b. (1) refugee card, the card of a foreigner granted asylum, and the card of foreigner with humanitarian status is obtained in person, and exceptionally - by an authorized person upon presentation of a notarized power of attorney.
(2) refugee card, the card of a foreigner granted asylum, and the card of foreigner with humanitarian status of minors and persons under legal disability is derived from a parent, guardian or custodian, and exceptionally - by an authorized person upon presentation a notarized power of attorney.
(3) refugee card, the card of a foreigner granted asylum, and the card of foreigner with humanitarian status of minors in homes for children deprived of parental care was received by the director of the specialized institution in cases of art. 63a para. 5. "
§ 53. Article 64 is repealed.

§ 55. In art. 65 is amended as follows:

a) in the text before item. 1 the words "identity documents" are replaced by "personal documents";
B) ie. 1, 2 and 3 the words "identity documents" are replaced by "Bulgarian identity documents."
2. Paragraph 3 is amended as follows:
"(3) On the basis of the automated informational funds under para. 1 a National Automated Information Fund Bulgarian identity documents - "National Register of Bulgarian identity documents". "
§ 56. In art. 66 is amended as follows:
1. In para. 1, 'Bulgarian identity documents "are replaced by" Bulgarian identity documents. "
2. Paragraph 2 is amended as follows:
"(2) in the information under par. 1 stored data for imposed measures of state compulsion related to identity documents and residence permits for foreigners or their stay in Bulgaria. "
§ 57. In art. 69, para. 1 the words "identity documents" are replaced by "Bulgarian identity documents."
§ 58. In art. 70 be made the following amendments:
1. In para. 1:
a) in the text before item. 1, 'Bulgarian identity documents "are replaced by" Bulgarian identity documents ";
B) in Item. 1 shall be added "as well as persons entrusted by law to perform public functions";
C) points 2 and 3 are amended as follows:
"2. citizens holding Bulgarian identification documents only if the data do not affect third parties; 3
. legal entities on the basis of law or an act of the judiciary. "
2. Paragraph 3 is amended as follows:
"(3) Citizens holding Bulgarian identity documents, are entitled to receive information stored in the funds with data related to Bulgarian and documents pertaining to third parties only on the basis of law or an act of the judiciary. "
§ 59. In art. 72 words "Bulgarian identity documents" are replaced by "Bulgarian identity documents" and the words "Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data" are replaced by "the Law on Personal Data Protection and Convention № 108 Council of Europe of 28.01.1981 on the protection of individuals with regard to automatic processing of personal data, done at Strasbourg on January 28, 1981, ratified by law (SG. 56 of 2002) (SG. 26 2003). "
§ 60. In art. 74 be made the following amendments:
1. A new paragraph. 2:
"(2) seized identity cards are stored by the body who has taken to dropping the measure, as this immediately notify in writing the relevant structure of the Ministry of Interior issued the document."
2 . Former para. 2 becomes para. 3.
§ 61. In art. 75 be made the following amendments:
1. In the text before item. 1 comma and the words "and passports and substituting documents are not issued" shall be deleted.
2. Point 3 is amended as follows:
"3. persons sentenced to imprisonment of up serving their sentence, except in cases of art. 66 and 70 of the Penal Code. " 3
. A pt. 6:
"6. persons who do not fulfill an enforceable court decision under which they are ordered to pay pecuniary obligation in large sums to Bulgarian natural and legal persons or foreign persons unless they provide proper security. "
§ 62. In art . 76 be made the following amendments:
1. In the text before item. 1 comma and the words' passports and substituting documents can not be issued "shall be deleted.
2. In item. 1 the word "three" is replaced by "five". 3
. Points 2, 3, 4, 5, 6, 7 and 8 are repealed.
4. In pt. 9 after the word "no" is added "notarized".
§ 63. In art. 76a para. 1, 'during their stay abroad "are deleted.
§ 64. In art. 79, para. 2 words "item. 1-3 "are deleted.
§ 65. Section I of Chapter Seven creating art. 79a:
"Art. 79a. The modalities for the storage and destruction of files on the implementation of measures under this section shall be determined by the Minister of Interior, Chairman of State Agency "National Security" and the chairman of the State Commission on Information Security. "
§ 66 . In art. 80 is amended as follows:
1. In item. 1 the words "identity documents" are replaced by "Bulgarian identity documents."
2. In item. 2 the words "identity document" are replaced by "Bulgarian identity document". 3
. In item. 3, 'Bulgarian identity document "are replaced by" Bulgarian identity document ".
4. In pt. 5, the words "identity document" are replaced by "Bulgarian identity document".
§ 67. Article 81 is amended as follows:
"Art. 81. (1) A fine of 20 to 150 lev person:
1. not apply for replacement of their Bulgarian identity documents within 30 days of a change of name, personal identification number, gender, nationality, domicile or substantial and permanent changes of the image;
2. underperformed as a parent, guardian or custodian supply identity card of a person under 14 years of age; 3
. not apply for an ID card within 30 days after it said that it is damaged, destroyed, lost or stolen;
4. It is over 18 years old and has not submitted an application for an ID card;
5. not apply within 30 days for replacement identity card after the expiry of its validity;
6. does not return your passport or substituting document of the authority that issued it within three months after its expiry or after dropping the grounds for issuance or use.
(2) A fine of 30 to 200 lev person:
1. Bulgarian citizen and did not announce the competent Bulgarian authorities acquisition of identity documents issued by another country within the set deadline;
2. lost, damage or destroy Bulgarian identity document; 3
. It is not declared within three days of loss, theft, damage or destruction of Bulgarian identity document;
4. has declared Bulgarian identity document for damaged, destroyed, lost or stolen and found that continues to use it;
5. announced misrepresentation in an application for issuance of Bulgarian identity document, unless subject to a more severe penalty under another law;
6. uses invalid Bulgarian identity documents;
7. prevent the authorities empowered to examine to establish his identity.
(3) For repeated violation under par. 2 penalty is a fine of 50 to 300 lev.
(4) The diplomatic and consular missions of the Republic of Bulgaria abroad levy and collect fines calculated in US dollars, euros or local currency. "
§ 68. Article 82 is amended as follows:
"Art. 82. For minor violations of this Act shall apply the provisions of art. 28 of the Administrative Violations and Sanctions or impose a fine on a receipt to 20 lev by authorized officials. "
§ 69. In additional provision be made the following amendments:
1. The name was changed to "additional provisions".
2. In § 1:
a) Section 2 is amended as follows:
"2. "Irregular Bulgarian identity document" is one that:
a) has not been issued under this Act and does not contain data provided therein;
B) has not been officially certified by the authority that issued it when required or issued by any person or body who are not competent;
C) does not allow establishing the identity of the holder's photo;
D) contains corrections, deletions, deletions, additions and others;
E) there are traces of replacement photo, the seal is unclear or image of the photo does not coincide with the actual image;
F) has missing pages or added new ones;
G) has expired;
H) with discrepancies between the electronic media and the visual part of the document;
S) is available for reading electronic information carrier due to injury. "

"§ 1a. Bulgarian identity documents are issued with electronic data carrier with stored biometric data, if technically possible. "
§ 70. In the transitional and final provisions be amended as follows:
1. Paragraph 2 is amended as follows:
"§ 2. 5. Paragraph 20 is amended as follows:
"§ 20. Applications for seaman's passports be submitted to the Ministry of Transport, Information Technology and Communications, where ex officio sent in the Sofia Directorate of Interior Regional Directorate of the Ministry of Interior (CDI / RDMI ) in which the applicant appear in person to collect biometric data. § 86. In the Ministry of the Interior (Prom. SG. 17 of 2006 .; amend., SG. 30, 102 and 105 of 2006 Nos. 11, 31, 41 46, 57, 64 and 109 of 2007, pcs. 28, 43, 69, 94 and 98 in 2008, pcs. 27, 42 and 74 of 2009) is amended as follows:
1. In art. 7, p. 18, the words "identity documents and licenses" are replaced by "Bulgarian identity documents."
2. In art. 59 para. 3 pt. 1 the words "Art. 18 pt. 1-20 of the Law on Bulgarian identity documents "are replaced by" Art. 18 of the Law on Bulgarian identity documents. " 3
. In art. 140, para. 1, p. 19 words "identity documents" are replaced by "Bulgarian identity documents."
§ 87. In the Law on Notary (prom. SG. 104 of 1996 .; amend. Pcs. 117, 118 and 123 of 1997, pcs. 24 1998 SG. 69 of 1999, No. 18 of 2003, pcs. 29 and 36 of 2004, pcs. 19 and 43, 2005, pcs. 30, 39 and 41, 2006, issue. 59 and 64 of 2007, pcs. 50 and 69 in 2008, pcs. 42 and 47 of 2009) the following amendments:
1. In art. 19:
a) the previous text becomes para. 1;
B) a par. 2:
"(2) A notary has the right of access to the National Database" Population ", supported by the Ministry of Regional Development and Public Works and the National Automated Information Fund Bulgarian identity documents -" National Register of Bulgarian identity documents "under terms and conditions established by the Council of Ministers."
2. In art. 25:
a) a new para. 3:
"(3) In any notary certificates in connection with the establishment, modification or termination of rights to property, the notary is obliged to consult the database and funds under Art. 19, para. 2. ";
B) the previous paragraph. 3, 4, 5, 6 and 7 become par. 4, 5, 6, 7 and 8.
§ 88. In the BULSTAT Register Act (prom. SG. 39 of 2005 .; amend. Pcs. 105 of 2005, pcs. 34 2006, No. 42 of 2007) is amended as follows:
1. In art. 29, para. 2 t. 2 is amended as follows:
"2. National Automated Information Fund Bulgarian identity documents - "National Register of Bulgarian identity documents". "
2. In art. 31, para. 1 the words "National information fund" Bulgarian identification documents "are replaced by" National Automated Information Fund Bulgarian identity documents - "National Register of Bulgarian identity documents" and the words "identity documents" are replaced by "Bulgarian identity documents."
§ 89. In the Law on Asylum and Refugees (prom. SG. 54 of 2002 .; amend., SG. 31 of 2005, No. 30 of 2006, pcs. 52 and 109 2007) in art. 45, para. 3, 'Law on Bulgarian identity documents "are replaced by" the Bulgarian identity documents. "
§ 90. In the Law on Foreigners in the Republic of Bulgaria (prom. SG. 153 of 1998 .; amend., SG. 70 of 1999, pcs. 42 and 112 of 2001, pcs. 45 and 54 of 2002, pcs. 37 and 103 of 2003, pcs. 37 and 70 of 2004 Nos. 11, 63 and 88 of 2005, pcs. 30 and 82, 2006 pcs. 11, 29, 52, 63 and 109 of 2007, pcs. 13, 26, 28 and 69 of 2008, pcs. 12, 32, 36 and 74 of 2009) is amended as follows: | || 1. In art. 49, para. 1, p. 5, the words "identity document" are replaced by "Bulgarian identity document".
2. In art. 58 words "identity documents" are replaced by "Bulgarian identity documents."
§ 91. (1) Paragraph 87 shall enter into force on January 1, 2010
(2) Until January 1, 2010 Council of Ministers shall act under § 87 pt. 1, letter "b".
