NUM Law. 20.869 ON THE ADVERTISEMENT OF THE FEED Having present that the National Congress has given its approval to the following Bill: " Article 1.-Advertising that leads to the consumption of the foods mentioned in the paragraph is prohibited. Article 5 of Law No. 20,606, on the nutritional composition of foods and their advertising, which, due to their graphic presentation, symbols and characters used, is directed to children under the age of fourteen, preferably capturing their attention. No food advertising may claim that the products concerned satisfy the nutritional requirements of a human being alone. In addition, you should not use violence or aggressiveness and will not be able to associate minors with the consumption of alcoholic beverages or tobacco. The provision or delivery of the food referred to in the first subparagraph shall be prohibited, for the purposes of promotion or advertising, to children under the age of 14. Article 2.-All advertising actions aimed at promoting the consumption of the food referred to in the first paragraph of Article 5 of the Law No. 20,606, on the nutritional composition of foods and their advertising, in all Television and film services may only be broadcast in such means between 22:00 and 6:00 hours, provided they are not intended for children under the age of fourteen. By way of exception, advertising actions may be carried out on foods previously indicated for sporting, cultural, artistic or social welfare events or spectacles, outside the timetable set out in the preceding paragraph, where the following requirements are met: (a) that the event or show is not organised or financed exclusively by the undertaking concerned by the advertising or by its coligadas or related. (b) that advertising is not intended or directed, directly or indirectly, to minors under the age of 14. (c) the advertising does not show consumer situations which induce the latter or the promoted product. (d) that the advertising is limited to the display of the trademark or name of the product. Article 3.-Add in article 6 of Law No. 20,606, on the nutritional composition of foods and their advertising, the following final point: "In all those provisions of this law where the expression" minors " is used, it must (a) to be understood as referring to children under the age of 14. ' Article 4.-Regulations on advertising and promotion of food shall be issued by the President of the Republic through the Ministry of Health. Article 5.-All advertising of substitute foods for breast milk is prohibited. The term "start formulas" and "follow-on formulae" until the twelve months of age, as laid down in the Food Regulations, contained in the Supreme Decree No. 977, of the Ministry of Health, are understood as substitutes for breast milk. Health, enacted in 1996 and published in 1997. The professional required to indicate these formulas must ensure that the user has the necessary information to properly select the respective formula, pointing out in the recipe the generic name of the formula, i.e. and the age of the child or child who will receive it. The violations of the provisions of this article will be sanctioned according to the Book Tenth of the Health Code. " And because I have had to approve and sanction it, therefore promulgate and take effect as Law of the Republic.
