LAW NO. 20,865 CREATES AN ALLOCATION OF STRENGTHENING OF THE HEALTH AUTHORITY Having present that the National Congress has given its approval to the following Bill: " Article 1.-Establish, to count from the date of publication of this law, an allocation for the strengthening of the health authority, directed to the plant staff and to the contract of the Public Health Undersecretary, governed by the decree with force of law Nº29, 2004, of the Ministry of Finance, which fixes the text recast, coordinated and systematized of law Nº18,834, on Administrative Statute, and by the Decree Law Nº249, 1973, which sets a Single Pay Scale for the staff that it points out. The Minister of Health and the Undersecretary of Public Health will not be entitled to this assignment. Article 2.-The allocation of strengthening of the health authority shall contain a fixed component and a proportional component. Such allocation shall be paid monthly. It will also be taxable and taxable, and will not serve as a basis for calculating any other remuneration. Staff who provide services for a period of less than one month shall be entitled to be paid the allowance in proportion to the full days actually worked. Article 3.-The fixed component of the allocation will amount to $100,000 monthly gross. In the month of December 2017, it shall be readjusted in accordance with the general remuneration adjustments to be granted to public sector workers. Article 4.-The proportional component of the allocation shall be 10% of the sum of the following remuneration, as appropriate: (a) Base salary. (b) Assignment of Article 19 of Law No 19.185. (c) Allocation of Articles 17 and 18 of Law No 19.185. d) Allocation of article 6 of Decree Law Nº1,770, 1977. Article 5.-The Public Health Secretariat shall define an annual institutional plan containing the main lines of action, objectives, indicators and institutional goals, which shall be fulfilled during the following calendar year. This plan will be sent by the Public Health Secretariat to the Senate and Chamber of Deputies Health Committees in December of the year before its execution. In addition, the Public Health Secretariat shall submit to these commissions a management report containing the results obtained, the percentage of compliance with the plan, and the corrective and preventive measures taken for compliance with the the goals set. The maximum period for submission of this report shall be the month of January of the following year, and a progress report shall also be submitted in July of each year. Transitional Articles Article 1.-The components of the health authority's allocation of strengthening shall be subject to the progression indicated for each of the years indicated: 1) From the date of publication of this law until December 31, 2015: a) Fixed component: $50,000 monthly gross. (b) Proportional component: 6%. 2) From January 1, 2016 to November 30, 2016: a) Fixed component: $70,000 monthly gross. (b) Proportional component: 8%. 3) To count from December 1, 2016: a) Fixed component: $100,000 monthly gross. (b) Proportional component: 10%. Article 2.-Establish, for one time, a bonus of $150,000 gross for plant personnel and to hire from the Public Health Secretariat governed by the decree with law force Nº29, 2004, of the Ministry of Finance, which fixes the text a consolidated, coordinated and systematised law Nº18,834, on Administrative Statute, and by decree law Nº249, 1973, which sets the Single Scale of Wages, which is in service to the date of publication of this law. This bonus will be paid in two installments as follows: a) $50,000 gross, which will be paid in conjunction with the first payment of the allowance set out in article 1 of this law. b) $100,000 gross, which will be paid in January 2016, in conjunction with the payment of the aforementioned allocation. This bonus will not be taxable or taxable, and will not serve as the basis for any other remuneration. Officials shall also be paid in service to the date for the payment. Article 3.-The largest fiscal expenditure that represents the implementation of this law during its first financial year will be financed from the budget of the Ministry of Health. Notwithstanding the foregoing, the Ministry of Finance, under the budget heading of the Treasury, may supplement that budget in the portion of the expenditure that cannot be financed from these resources. In the following years, it will be in line with what is considered by the respective Public Sector Budget law. " And because I have had to approve and sanction it; therefore, promulgate and take effect as the Law of the Republic.
