LAW NO. 20,215 AMENDS RULES REGARDING WORKERS DEPENDENT ON TRADE IN PERIODS OF PATRIOTIC HOLIDAYS, CHRISTMAS AND OTHER FESTIVITIES Having present that the National Congress has given its approval to the following Bill: " Article 1.-Please introduce the following amendments to the Labour Code: 1. Substitute, in the first paragraph of Article 24, the phrase "in the periods immediately preceding Christmas, patriotic parties or other festivities", for the following: " for nine days prior to Christmas, distributed within the last Fifteen days before this holiday. " 2. In Article 24, the following third and fourth subparagraphs shall be added: " The workers referred to in the first subparagraph shall, in no case, work beyond 23 hours during the nine days in which the Ordinary day. Likewise, under no circumstances shall they do so beyond the 20 hours of the day immediately preceding that holiday, as in addition to the day immediately before 1 January of each year. Infringements of the provisions of this Article shall be punishable by a fine for the tax benefit of 5 monthly tax units for each worker affected by the infringement. If the employer has 50 or more employees, the applicable fine shall be 10 monthly tax units for each worker affected by the infringement. And where 200 or more employees are employed, the fine shall be 20 monthly tax units for each worker affected by the infringement. " 3. Add the following article 35 ter, new: " Article 35 ter.-In each calendar year on 18 and 19 September, respectively, on Tuesday and Wednesday, respectively, or Wednesday and Thursday, it shall be a holiday on Monday 17 or Friday 20 of that month, as the case may be. ' Article 2.-The following amendments are made to Article 2 of Law No 19,973: 1. Interleave, between the word "days" and "18", the expression "May 1,". 2. Replace the expression "the workers who work in shopping centers or mall." by the prayers " dependent on trade, with the exception of those who perform in clubs, restaurants, entertainment establishments, such as, cinemas, live shows, discos, pub, cabarets, gambling casinos and other legally authorized gambling venues. It shall also not apply to fuel supply dependents, emergency pharmacies and pharmacies which are required to comply with shifts laid down by the health authority. " 3. Add the following second indent: " Violations of the provisions of this article shall be sanctioned with a fine for the tax benefit of 5 monthly tax units for each worker affected by the infringement. If the employer has 50 or more employees, the applicable fine shall be 10 monthly tax units for each worker affected by the infringement. And where 200 or more employees are employed, the fine shall be 20 monthly tax units for each worker affected by the infringement. ' Transitional Article-State holiday on Monday 17 September 2007.
