IT EMPOWERS THE DIRECTOR OF THE INSTITUTE FOR PRE-RETIREMENT STANDARDS TO MAKE PROGRESS IN THE TRIALS IT INDICATES AND TO CONDUCT EXTRA-JUDICIAL TRANSACTIONS IN ORDER TO PREVENT ANY DISPUTES, IN THE CASE OF PENSIONS. The National Congress has given its approval to the following Bill: Single Article.-Facultate the Director of the Institute for Contingency Normalization to deal with litigation in the Courts of Justice, in the Fiscus and, or, that Institute, or the respective Institution of Forecasting of which the is legal successor, and, likewise, in order for it to be settled out of court in order to prevent any disputes, relating to the application and interpretation of Decree Law No 615 of 1974, in the terms and conditions set out in the numbers The following: 1 ° Retirement pensions granted in accordance with the rules laid down in the laws N ° s. 11.745, 12.566, 13.044, 14.113 and article 55 of Law No 17.272, in decrees with force of law N ° s. 1,340 bis, 1930, and 338, 1960, and other relevant legal provisions, are to be reliqued for the purposes of this law for the purposes of this law, considering 80% of the salary as defined in Article 55 of Law No 17.272, which includes the each professional assignment, in force on 9 February 1979, and on the latter date, applying the corresponding adjustments provided for in Article 14 of Decree Law No 2,448, published in the Official Journal on 9 February 1979, and its amendments; 2 ° The pensions thus reliquidadas shall begin to become payable since the publication of the This law, in respect of all pensioners in that quality, which are subject to the transation authorized in this law, shall be reestablished in accordance with the general arrangements laid down in Article 14 of Decree Law No 2,448 of 1979 and their 3 ° In the cases of court proceedings, each party will pay its costs; 4 ° By this transaction the respective disputes are terminated and the eventual ones are prevented; the actors and other interested parties who agree to it, give their full satisfaction in their rights and irrevocably renounce any action which 5 ° The pensioners referred to in this law who wish to agree on such a transaction, must express their will to compromise in the terms indicated in this article, by written declaration that they must present before the Institute of Normative Standardisation, within the period of 6 months counted from the validity of this law; 6 ° For the only act of the manifestation of will made by the interested party in the terms referred to above, it shall be understood as agreed the respective transaction; 7 ° In cases of pending litigation, the Institute itself, or the actor, give the Court of the fact that the transaction has occurred; 8 ° The same relief shall apply, at the date indicated in the second paragraph of this Article, to the surviving pensions in force for the the date of publication of the law, caused by the pensioners who died after 31 December 1973. To this end, the beneficiaries shall be eligible for the transaction within the term referred to in Article 5 of this Article; 9 ° The expenditure incurred by this law shall be financed from the budget of the Institute for Standardisation Pension.
