THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF THE SALVADOR,

CONSIDERING:

I.- That Legislative Decree No. 1037, dated 27 April 2006, published in Official Gazette No. 95, Volume No. 371, dated 25 May 2006, issued the Organic Law of the Office of the Attorney-General of the Republic;

II.- That in verbatim (b), of Art. 26, of the said law, is established as the attribute of the Attorney-General, to appoint, remove, transfer, grant licences and accept resignations from the Deputy Attorney-General, and Art. 30, of the same legal body, in paragraph (a) states that it is for the Deputy Attorney-General, to supplement the temporary absences of the Attorney-General of the Republic, in charge of the office, in accordance with the ordinary matters and in the extraordinary case of termination,

III.- However, to be an attribute of the Attorney-General, to elect the Deputy Attorney-General, with the implications indicated in the previous consideration, the law in reference does not set a time limit for the Attorney-General to make this appointment;

IV.- In order to establish a reasonable time for the Attorney-General to elect the Deputy Attorney-General, it is appropriate to incorporate the corresponding reforms in the Organic Law of the Office of the Attorney-General of the Republic.

DECRETE: the following

Reforms to the Organic Law of the Attorney General's Office, like this:

Art.1.- Addendum to Art.25, subparagraph (e), as follows:

(e) For the failure to comply with the provisions of article 26, paragraph 2 (b), of this law. ”

Art. 2.- Addendum to paragraph (b), of Art. 26, the following subparagraph:

“For the appointment of the Deputy Attorney-General, referred to in the preceding paragraph, the Prosecutor-General shall have a maximum period of thirty days from the date on which he takes possession of the

and the same time limit shall have, to appoint the substitute, when for any reason, the charge shall be vacant. ”

Art. 3.- Transitory.

If upon entry into force of this Decree, the current Attorney-General of the Republic had not appointed the Deputy Attorney-General, it is established a period of thirty days to do so, counted from the aforementioned validity.

Art. 4.- This Decree shall enter into force eight days after its publication in the Official Gazette.
