INDEX LEGISLATIVE DECREE No. 871

THE LEGISLATURE OF THE REPUBLIC OF EL SALVADOR, CONSIDERING
:
I.- by Legislative Decree No. 1037, dated 27 April 2006, published in Official Journal No. 95, Volume No. 371, dated May 25, 2006, the Organic Law of the Attorney General of the Republic was issued;
II.- That the literal b) of Art. 26 of the Act, is set dependent on the Attorney General to appoint, remove, transfer, licensing and accept resignations to the Attorney General, and Art . 30, the same legal body, in the literal a) establishes that the Deputy Prosecutor General, meet the temporary absence of the Attorney General of the Republic, in charge of the office, attending to the affairs of ordinary and the extraordinary case of cessation of it in office for any reason, while choose and inauguration of the newly elected official; III.-
however, be an attribution of the Attorney General, Deputy Attorney General elect, with the implications mentioned in the previous paragraph, the reference law does not set a deadline for the Attorney General make this appointment;
IV.- That in order to establish him to the Attorney General a reasonable period to elect the Deputy Prosecutor General, it is appropriate to incorporate the relevant reforms in the Organic Law of the Attorney General of the Republic.
THEREFORE,
in exercise of its constitutional powers and initiative of the deputies Othon Sigfrido Reyes Morales, Carmen Elena Calderón Sol Escalon, Norma Guevara Ramirios Fidelia, Medardo GonzàlezTrejo, Zoila Beatriz Quijada Solis, Francisco Roberto Lorenzana Duràn, Vaquerano Eugenio Donato Rivas, Federico Guillermo Avila Quehl, Luis Roberto Samayoa angle, and Santos Guevara Ramos.
DECREES: The following
Amendments to the Organic Law of the Attorney General of the Republic, thus:
Art.1.- hereby added to Section 25, paragraph e), as follows: | || "e) failure to comply with the provisions of the second paragraph, the literal b) of Art.26 of this law."
Art. 2. hereby added to paragraph b) of Article 26, the following paragraph:.
"For the appointment of the Deputy General Prosecutor, referred to in the preceding paragraph, the Attorney General will have a maximum of thirty days from the day of taking possession of

office, and the same term will, to appoint the substitute, when for any reason, the position becomes vacant. "
Art. 3. Transitory.
If the entry into force of this Decree, the current Attorney General of the Republic, had not appointed Assistant Attorney General, was established within thirty days to do, counted from the aforementioned effect.
Art. 4. This Decree shall enter into force eight days after its publication in the Official Journal.
