Given Decree No. 47-77 of 13 January 1947 as amended relating to the duties of the heads of consular posts and the heads of diplomatic missions in respect of passports and visas;
Having regard to Decree No. 2001-185 of 26 February 2001 on the conditions for the grant and renewal of the Passports;
Having regard to Decree No. 2002-701 of 29 April 2002 on the protection of citizens of the European Union by the diplomatic and consular representations of France;
Having regard to Decree No 2003-1377 of 31 December 2003 concerning Entry in the register of French nationals established outside France, in particular Article 6,
Décrète:
Heads of consular posts can:
-issue or renew passports under the conditions set out in the aforementioned decree of 26 February 2001 and this Decree;
-issue passes Under the conditions laid down in this Decree.
I. General
The Minister for Foreign Affairs may, by order:
-designate the heads of consular posts responsible for issuing or renewing passports or To issue passes in a given country or geographic area;
-assign all or part of the powers provided for in this Order to the Director of French abroad and foreign nationals in France.
Only quality for issuing or renewing a passport or issuing a pass to the heads of consular posts and Heads of diplomatic posts filled with a consular district.
However, they may delegate their signature, in this matter, under their responsibility to one or more officials under their authority having the status of public servant. The name of the delegated officer (s) is published by posting, within the premises of the position, in a place accessible to the public.
II. -The passport
French nationals established outside France may apply for the grant or renewal of a passport to the Head of a territorially competent consular post because of their residence.
Heads of consular posts can also issue individual emergency passports, of a particular model, in one of two cases:
-for a Duly justified grounds of urgency;
-where they are not territorially competent because of the applicant's residence.
III. -Pass-through
Pass is an individual travel document issued for a single trip and a maximum duration Thirty days from the date of its establishment.
The pass is established on a form Are defined by order of the Minister for Foreign Affairs. It shall contain different indications according to whether it is issued to a Frenchman or a foreign national.
One Passes may be issued to a French person with no travel document or document that can be issued for a single trip to France, in particular in the event of a physical impossibility of issuing a passport, and after Verification of his identity and his French nationality.
It is established on the return of the loss or theft of the travel document to which the pass is substituted.
The pass may be issued to a foreign national who has no travel document or document to hold, unable to obtain one of the authorities His or her country of origin or local authorities, in one of the following situations:
(a) After consulting the Minister for Foreign Affairs, for a single trip to France:
1. To the foreign national who has in France the status of refugee or stateless person or holder of a provisional receipt issued by the French Office for Refugees and Stateless Persons;
2. To the spouse, to the minor dependent child of the foreign national who has in France the status of a refugee or stateless person, entitled to enter and stay in France under a visa;
3. A foreign national authorized to reside in France under a residence permit;
4. A national of a non-EU Member State authorised to enter and stay in France on the basis of a short-stay visa;
5. A minor foreign national who has been adopted abroad at the request of the enacting parent authorised to enter and stay in France on the basis of a long-stay visa for adoption of one year;
b) After consultation with the authorities From its country of origin, to the national of a Member State of the European Union referred to in Article 1 of the decree of 29 April 2002 referred to above, for a single journey to the Member State of the European Union in whose territory it resides, Directly or in transit through another Member State of the European Union, including France;
(c) After consulting the authorities of its country of origin, for a single journey to its country of origin, to the national of a State not Member of the European Union, of which France provides the consular representation, in the absence of any special provisions laid down in the agreements between France and the States of which it provides protection for nationals.
The pass is given to the applicant instead of filing the application. The applicant signs on the pass in the presence of the agent who gives it to him. A minor's pass is given to him in the presence of one of the persons exercising parental authority. If he is over thirteen years of age, the minor himself signs on the pass.
The holder of a Laissez-passer issued for a trip to France gives it:
-without delay, to the police authorities on the French border;
-within the limit of its validity, to the prefectural authority to which it owes the case Need to perform a formality.
The authority to which the pass was given is returned to the Minister for Foreign Affairs.
IV. -Final provisions
The terms and conditions of this Order are defined by order of the Minister of Business Foreign.
I. Articles 1, 2 and 3 of the aforementioned Decree of 13 January 1947 are hereby repealed.
II. -At the end of the first paragraph of Article 4 of the Decree of 13 January 1947 referred to above, the word 'foreign' shall be deleted.
III. -In Article 4-1 of the aforementioned Decree of 13 January 1947, the words'in Articles 3 and 4' shall be replaced by the words'in Article 4'.
IV. -In Article 5-1 of the Decree of 13 January 1947 referred to above, the words'in Articles 1, 3, 4 and 4-1 shall be replaced by the words' in Articles 4 and 4-1 '.
V.-In Article 6 bis of the aforementioned Decree of 13 January 1947, the words: " to articles 1 to 4 "shall be replaced by the words" in Article 4 ".
VI. -The title of the Decree of 13 January 1947 is amended as follows: "Decree No. 47-77 of 13 January 1947 on the duties of the heads of consular posts in respect of visas".
The Minister for Foreign Affairs is responsible for the execution of this Decree, which will be published in the Official Gazette of the French Republic.
