This Order sets out the length of stay and administrative leave arrangements applicable to expatriate staff, as defined in the second paragraph of Article 2 of the aforementioned Decree of 4 January 2002, Serving in French educational institutions abroad whose list is laid down in the order provided for in Article 1 of that decree.
It does not apply to:
-or resident personnel, within the meaning of Article 2, paragraphs 3 to 5, of the Decree of the 4 January 2002 above;
-or personnel recruited directly by educational institutions abroad;
-or civilian volunteers as defined in Article 3 of this decree.
I. -Time of stay
The qualifying period for reimbursement of expenses incurred by a travel of administrative leave in France is fixed, effective 1 September 2002, at one, two or three academic years, In accordance with the table in the Annex to this Order. Unless otherwise stated, residence time for personnel serving in the capital of a foreign country shall be applicable to all posts located in the territory of the country in question.
The expatriate agent cannot claim, for himself and his family, under the conditions laid down in Article 14 of the aforementioned Decree of 4 January 2002, the reimbursement of the costs of a holiday Administrative in France than at the end of a residence time. All school years must be consecutive and complete.
However, where the officer has, for a reason of force majeure, taken up his or her duties during the school year, the right to reimbursement of expenses incurred by a travel of leave Administrative is acquired if the person concerned has, in the first academic year, completed a minimum service of four or five months abroad, depending on whether the right to repayment is open after three or two academic years.
II. -Administrative leave
The expatriate agent is placed in the position of administrative leave during the period of the great school holidays of the country in which he exercises, the year in which he is entitled to reimbursement of the expenses occasioned by a trip Leave.
The duration of the administrative leave shall be, except in the interest of the service, equal to the prescribed duration of the major school holidays fixed by the authority responsible for the place of duty.
The provisions of The preceding paragraph shall not apply to the agent entitled to the reimbursement of expenses incurred by an assignment of a post abroad to another post abroad, or by a definitive return to France.
In this case, the agent shall be placed In situations of administrative leave as from the date on which he is no longer present at the post. It may be maintained in this situation for a period equal to the prescribed duration of the major school holidays of the country in which it has performed its functions. Upon completion of the administrative leave, an officer who is required to serve in another position outside Canada or who is required to be provided to his or her original authority may be placed in an assignment instance position.
The rights to administrative leave, acquired from the agent as soon as he has made the imposed residence time abroad, are not extinguished when he is replaced in his post or employment.
The Director of the Agency for French Education Abroad and the Director of the Budget in the Ministry of Economy, Finance and Industry are responsible, each as far as it is concerned, for the execution of the This Order, which will take effect on 1 September 2002 and shall be published in the Official Journal of the French Republic.
