In view of the 1978 International Convention on Standards De formation des gens de mer, de grant des brevets et de veille, published by Decree No. 84-387 of 11 May 1984, as amended in its annex by the amendments adopted in 1995, published by Decree No. 97-754 of 2 July 1997;
Seen the Directive No 94 /58/EC of 22 November 1994 concerning the minimum level of training of seafarers, as amended by Council Directive 98 /35/EC of 25 May 1998;
In the light of Decree No. 84-810 of 30 August 1984 on the protection of life Human at sea, ship-borne habitability and pollution prevention;
In light of Decree No. 85-378 of 27 March 1985 on maritime vocational training;
In light of Decree No. 93-1342 of 28 December 1993 on conditions Exercise of the duties of captain and officer on board commercial, fishing and recreational vessels;
In light of Decree No. 99-439 of 25 May 1999 on the issue of professional maritime training qualifications and on conditions Carrying out duties on board commercial and fishing vessels as well as armed pleasure craft with a crew role;
In view of the opinion of the specialised committee on maritime professional training at its meeting on 27 June 2002,
Decline:
This Decree shall lay down the procedures for the exercise of the main functions at the level of support on board commercial and fishing vessels as well as armed pleasure craft with a crew role.
The main functions at the level of support exercised on board as defined by Article 2 of the decree of 25 May 1999 above include the following functions:
-deckhand " Bridge " For bridge service ;
- " Mechananian " For machine service;
-deckhand " Multipurpose " For multi-purpose bridge and machine service.
The specific support functions are set out in Chapter III of the aforementioned decree of 25 May 1999.
To perform the main functions at the support level, the candidate must meet the following conditions:
1. Meet the standards of medical fitness required for navigation under conditions laid down by the Minister responsible for the sea;
2. Have met the minimum standards of proficiency required for support functions under conditions established by the Minister responsible for the sea.
In the event of extreme necessity, derogations from the minimum qualification conditions may be granted under the conditions laid down in Article 5 of the aforementioned decree of 25 May
. Derogations can be renewed once.
The Minister of Equipment, Transport, Housing, Tourism and the Sea and the Secretary of State for Transport and the Sea shall each have responsibility for the execution of this Decree, which shall Will be published in the Official Journal of the French Republic.
