Decision No. 2003-717 of 16 December 2003 for the extension of the authority granted to the group Laser Group of M ' Tsapéré for l' exploitation d' an audio broadcasting service Terrestrial radio frequency modulation known as Radio Laser

The Conseil supérieur de l' audiovisuel,
In view of Act No. 86-1067 of 30 September 1986 on freedom of communication, in particular Articles 27, 28 and 28-1;
In view of Decree No. 87-239 of 6 April 1987, taken for the application of Article 27 (1 °) of Act No. 86-1067 of 30 September 1986 on freedom of communication and fixing, for private radio broadcasting services broadcast by terrestrial terrestrial or By satellite, the regime applicable to advertising and sponsorship;
In view of Decree No. 92-1047 of 23 September 1992 on propaganda and advertising for alcoholic beverages by means of sound broadcasting;
In view of Decree No. 94-972 Of 9 November 1994 for the application of the 1 ° of Article 27 of Act No. 86-1067 of 30 September 1986 on freedom of communication and defining the obligations relating to access to local advertising and local sponsorship of Authorised audio broadcasting services;
In view of the decision of the National Commission on Communication and Freedoms 87-23 of 6 March 1987, as amended by the decision of the Conseil supérieur de l' audiovisuel n ° 90-829 of 7 December 1990, Defining the technical conditions for the use of frequencies for the broadcasting of radio signals in frequency modulation;
Having regard to Decision No. 99-202 of 11 May 1999 renewing the authorisation of a service of Terrestrial over-the-air radio broadcasting in frequency modulation known as the Radio Laser;
Given the outcome of the deliberation of the Conseil supérieur de l' audiovisuel dated 11 March 2003 published in the Official Journal of 2 May 2003;
Seen the Agreement between the Conseil supérieur de l' audiovisuel and the association Laser Group of M' Tsapéré, in accordance with Articles 28 and 28-1 of the Act of 30 September 1986, as amended;
After having deliberated,
Decides:

Item 1


Authorization No. 99-202 dated May 11, 1999, above for the operation of a sound broadcasting service by way of Terrestrial radio frequency modulation called Radio Series One is renewed for a period of five years as of June 20, 2004.

Item 2


The above association is authorized to use the frequency specified in the appendix, in accordance with the above convention and the appendix to this decision.

Article 3


1 ° The holder of this authorization is required to provide the following information to the Senior Audiovisual Council, which it attests to the accuracy:
Information Communicated within two months after commissioning:
-technical description of the installation (type and rated power of the transmitter, antenna system ...) ;
-maximum effective radiated power (PAR) and horizontal and vertical theoretical radiation diagram;
-date of commissioning.
Information provided without delay, if available:
-radiation diagram Measured;
-frequency excursion (statistical percentage of exceedance of 75 kHz over a minimum of 15 min).
This information is due at the express request of the board.
2 ° If the information mentioned in 1 ° is changed The holder shall, at a later date, communicate to the Council an updated version within one month.
3 ° The holder is also required to provide the Council with any information in his possession on the coverage of the issuer, in particular the Results of the coverage measures carried out in the service area.
4. If the Council finds that the technical requirements of this authorisation are not complied with, the holder is required to carry out, by an approved body, a Verification of the conformity of its installation with the requirements set out in the Technical Annex to the authorisation. It shall forward to the Board the results of this audit.

Article 4


This authorization is not transferable.

Article 5


Any use of a sub-carrier must be authorized by the Audio-Visual Higher Council.

Article 6


This decision will be notified to the M' Tsapéré Laser Group Association and published in the Official Journal of the Republic French.
