DECRET
Decree No. 2007-26 of 5 January 2007 laying down the duties of senior commanders in the overseas departments and regions, in the overseas communities governed by Article 74 of the Constitution And New Caledonia

The President of the Republic,
On the report of the Prime Minister, the Minister of Defence and the Minister for Overseas Affairs,
Given the Defence Code, including its Articles L. 1221-1, L. 1521-1 et seq;
In light of Decree No. 64-11 of 3 January 1964 on the organisation of defence responsibilities in the overseas departments and territories, as amended by Decree No. 92-615 of 6 July 1992;
Vu Decree No. 73-235 of 1 March 1973 on the operational defence of the territory, as amended by Decree No. 80-207 of 17 March 1980 and by Decree No. 2004-106 of 29 January 2004;
In the light of Decree No. 73-237 of 2 March 1973 on defence , as amended by Decree No. 91-676 of 14 July 1991 and by Decree No. 2004-106 of 29 January 2004;
Having regard to Decree No. 74-968 of 22 November 1974 establishing the organization of the commandments of maritime zones;
In view of Decree No. 91-671 of 14 July 1991 amending the general organisation of the national navy;
Given the decree n ° 91-672 of 14 July 1991 on the general organisation of the air force, as amended by Decree No. 94-213 of 11 March 1994, Decree No. 2004-106 of 29 January 2004 and Decree No. 2005-1160 of 14 September 2005;
In the light of Decree No. 2000-555 of 21 June 2000 on the territorial organisation of defence, as amended by Decree No. 2005-273 of 24 March 2005;
In view of Decree No. 2000-559 of 21 June 2000 on the general organization of the army, as amended by Decree No. 2005-646 of 6 June 2005 and by Decree No. 2005-1160 of 14 September 2005;
In view of Decree No. 2004-112 of 6 February 2004 concerning the organization of The action of the State at sea;
In light of Decree No. 2004-1102 of 15 October 2004 on the regulation of the garrison service;
Having regard to Decree No. 2005-506 of 19 May 2005 laying down the powers of the Minister of Defence;
In view of Decree No. 2005-520 of 21 May 2005 laying down the duties of the Chiefs of Staff;
Having regard to Decree No. 2005-1514 of 6 December 2005 on the overseas organization of the action of the State at sea,

In the overseas departments and regions, in the overseas communities governed by Article 74 of the Constitution and New Caledonia, the command of the armed forces is exercised by officers General with the title of:
-superior commander of the armed forces in the Antilles;
-superior commander of the armed forces in Guyana;
-the superior commander of the armed forces in the Southern Indian Ocean zone;
- Commander of the armed forces of New Caledonia;
-superior commander of the armed forces of French Polynesia.

The superior commanders referred to in section 1 of this Order shall be placed under the authority of the Chief of the Defence Staff.

The superior commanders referred to in Article 1 of this Decree shall have the powers defined in Article L. 1221-1 of the Defence
. In accordance with the provisions of the decree of 3 January 1964 referred to above, the functions of the Commander of the Defence Zone and shall bear in that context the name of the General Officer of the Defence Area in accordance with Decree No. 2000-555 of 21 June
. The framework for the action of the State at sea, they shall provide to the Government delegate the function of advice provided for in Article 2 of the decree of 6 December 2005.

The superior commanders referred to in Article 1 of this Decree shall be assisted by three deputies, senior officers in each of the armed
. New Caledonia and in the local authorities referred to in Article 1 of this Decree, the head of which shall not be the seat of a superior command, the superior commander shall, where appropriate, have a military commander Departmental or territorial. The latter shall be the representative of the superior commander to the local authorities and shall exercise, in accordance with his instructions, the command of the forces stationed or placed at his disposal in the territorial community concerned or New Caledonia. It also exercises the powers of an arms commander defined by the aforementioned decree of 15 October 2004.

The superior commanders referred to in Article 1 of this Decree shall have authority over the formations and service elements of the three armies stationed within the territorial limits of their command
Exercise, when granted, an employment authority on local bodies in the other branches and services of the Ministry of Defence.
They may consent to signature delegations to their deputies Referred to in section 4 of this Order and to the local officials of the agencies on which they have an employment authority.
Territorial Commanders of the Overseas Gendarmerie report to senior commanders for planning And the execution of land defence missions.

The links to be established between the senior commanders referred to in section 1 of this Order and the Maritime Zone Commanders shall be subject to direction from the Chief of the Defence Staff.

The superior commanders referred to in section 1 of this Order have a joint staff appointed by the Minister of Defence.

The superior commander of the armed forces in the Southern Indian Ocean zone is entitled to correspond with the military bodies of the regional economic community of which States may be a member. African and Malagasy in its area of responsibility. He holds the heads of the French diplomatic missions to the member countries of that community informed of the relations he maintains as such and the movements which he may be required to carry out in those countries.

Decree No. 75-874 of 24 September 1975 fixing the duties of senior commanders in the overseas departments and territories is repealed.

The Prime Minister, the Minister of Defence, the Minister for Foreign Affairs and the Minister for Overseas Affairs shall each have responsibility for the execution of this Order, which shall be published in the Official Journal of the French Republic.
