Summary


Application of Order-in-Council 55-486 of April 30, 1955, in particular section 30.Established in 1951, assistance for the relief of telephone charges was extended to facsimile transmission charges in 1977. This aid, which was gradually inadequate, as defined in Articles R. 15 to R. 20 of the Post and Telecommunications Code, was abolished by Decree 98-376 of 14 May 1998. Indeed, the liberalisation of the telecommunications sector from 1 January 1998 made it necessary to adapt. Only the part intended to lighten the burden of facsimile transmission has been retained. Decree 98-793 of 4 September 1998, therefore, set up a device to assist in the facsimile transmission of daily newspapers. The aid, set up for a period of three years, ended in June 2001, with the last refund sitting on the expenditure of the first half of 2001.This aid was extended for a period of one and a half years by Decree 2002-858 of 3 May 2002. The last refund will therefore be sitting on the expenses of the second half of 2002.The help allows the printing of the daily newspapers in different centres of the place of publishing. In this way, decentralised printing in the provinces of national dailies is favoured in particular. The aid also allows for better management of the costs of distribution of daily newspapers, to the extent that printed copies directly in the province do not need to be transported since Paris.In view of the importance of decentralised printing for The economy of the press, to which the facsimile transmission conruns, it is important to extend the aid scheme beyond 2002. This extension is all the more necessary because the current system of decentralised printing is called, in the very short term, to be aware of important developments. A new system may, if necessary, be created in the light of the new landscape of decentralized printing resulting from ongoing discussions in the profession and the priorities of the Government. The aid is therefore set up for a period of one year (i.e. until the end of 2003), which is the subject of this Decree, extending the aid to the facsimile transmission of daily newspapers for their decentralised printing.

Decree n ° 2003-28 of 8 January 2003 establishing aid for facsimile transmission of daily newspapers for their decentralised printing

Prime Minister,
On the report of the Minister of Economy, Finance and Industry and the Minister of Culture and Communication,
Due to the postal code and Telecommunications;
Given the amended Decree No. 55-486 of 30 April 1955 on various financial provisions, in particular Article 30;
In view of Decree No. 98-376 of 14 May 1998 repealing Articles R. 15 to R. 20 of the Code of the Posts and telecommunications;
Given Decree No. 2002-858 of 3 May 2002 establishing aid for facsimile transmission of daily newspapers,
Décrète:

Item 1
Daily newspapers can receive support for expenses resulting from the use of telecommunications networks and services for their transmission through the facsimile process for printing in One or more centres different from the place of publishing, within the limits of the appropriations entered for that purpose to the general services budget of the Prime Minister.

Support is granted to daily newspapers that meet the following conditions:
-be written in French;
-benefit from a certificate of registration on the registers of the Joint Committee Publications and news agencies;
-be printed on newsprint for at least 90 % of their surface;
-appear at least five times a week.

The distribution of the aid between the dailies meeting the conditions laid down in Article 2 of this Decree shall be carried out by the media development directorate.
The subsidy is calculated on the basis of The reimbursement of up to 50 % of the expenditure resulting from the use of telecommunications networks and services by the publications concerned for their transmission through the facsimile process for printing in one or more Multiple centers different from the place of edit.

Requests for reimbursement of the expenses referred to in Article 3 shall be directed to the management of the media development, directly by the press companies or through operators Operating a remote transmission system for their account, in the form of semi-annual summary statements no later than 31 March for the repayment of the last half of the previous year and no later than 30 September for the first half of the previous year.
Applications must be accompanied by the following documents:

-a copy of the invoices for the expenses referred to in Article 3 for the period for which the refund is requested.
Where an application is submitted by an operator acting on behalf of the press undertakings, the latter shall undertake to pass on the amount of the aid allocated to it in proportion to that which is due to each of the beneficiary
