In view of articles L. 133-1 et seq. Of the Labour Code;
Having regard to the Order of 4 November 1988 and the successive orders, The Order of 4 June 2004, extending the national collective agreement on the promotion and construction of 18 May 1988 and the texts which amended or supplemented it;
In view of the amendment No. 18 of 20 September 2004 (minimum wages) to the National collective agreement referred to above;
Given the request for extension by the signatory organizations;
Given the opinion published in the Official Journal of November 27, 2004;
In view of the opinions gathered during the survey;
In view of the opinion Motivated by the National Commission for Collective Bargaining (Sub-Committee on Conventions and Agreements), collected in accordance with the procedure laid down in Article R. 133-2 of the Labour Code,
Stop:
Are made mandatory for all employers and employees included in the scope of the National collective agreement for the promotion-construction of 18 May 1988, as amended by the agreements of 18 December 1997 and 18 February 2000 not extended, excluding the construction sector of the individual houses, the provisions of the amendment N ° 18 of 20 September 2004 (minimum wages) to the aforementioned national collective agreement.
Article 1 is extended subject to the application of the provisions of Article 32 of the amended Act No. 2000-37 of 19 January 2000 introducing a Monthly remuneration guarantee.
The extension of the effects and sanctions of the aforementioned amendment shall be made from the date of the Publication of this Order for the remaining time to be run and the conditions laid down by the said rider.
The Director of Labour Relations shall be responsible for the execution of this Order, which shall be published in the Official Journal of the French Republic.
