In view of the opinion of the National Water Committee of 20 May 2003;
In view of the opinion of the General Council of Mayotte as of 17 December 2003;

Alternate members are appointed in number equal to that of the full members and under the same conditions.
The prefect of Mayotte determines by order, account Having regard to the characteristics of Mayotte:
a) The categories of users represented, the number of representatives of each category and the number of competent persons, which cannot be greater than two;
b) The list of State administrations represented on the basin committee;
(c) The seat of the committee.
A. -Representatives of the departmental community are elected by the General Council.
B.-The representatives of the municipalities and the inter-communal trade unions are appointed by the associations most representative of Mayotte's mayors. Two of them represent, on the one hand, the inter-communal unions organising the collection and treatment of waste and, on the other hand, the Intermunicipal Water and Sanitation Union of Mayotte.
The prefect of Mayotte determines the Arrangements for the application of the above paragraph.
C.-The prefect of Mayotte shall invite the bodies or groups representative of the categories of users mentioned in Article 1 to make known the names of the user representative (s)
by the Prefect of Mayotte.
The representatives of the socio-professional circles are appointed by the Prefect of Mayotte on the proposal of the Economic and Social Council And the Council of Culture, Education and the Environment of Mayotte.
E.-The State shall be represented by the prefect of Mayotte, or his representative, and the heads of decentralised services referred to in Article 1 (b).
The term of office of committee members is six years. However, the terms of office of those who are members of the committee because of their duties expire when they cease to perform such duties.
Any member appointed to replace a member of the committee shall carry out his or her term of office until The expiration of the term of office of its predecessor.
The term of office of the members of the committee is renewable.
The list of members and alternates of the basin committee is drawn up by the prefect of Mayotte and published in the collection of administrative acts of the prefecture.
The basin committee exercises the powers conferred on it by Article L. 213-2 and by paragraph VII of Article L. 652-1 of the Environment Code.
It may be consulted by a Minister Interested, or by the Prefect of Mayotte:
(a) On the establishment of administrative structures which would prove necessary and, where appropriate, on the elaboration of adaptations facilitating the application of the provisions of Chapters I to IV, VI and VII of Title I of Book II of the Environment Code;
(b) On water management in times of crisis.
The committee deliberates in plenary session. It can validly deliberate only if at least half of its members are present. However, where a summons has failed to convene a quorum, the proceedings following a second meeting shall be valid regardless of the number of members present. The proceedings shall be taken by a majority of the votes of the members present. In the event of an equal division of votes, the chairperson shall preponderantly.
The committee shall draw up its rules of procedure.
Every three years the committee elects a President and a Vice-Chair. The President is elected either from among the representatives of the local authorities, from among the representatives of the users and the competent persons, or from among the representatives of the socio-professional circles. The Vice President is selected in one of the two categories above to which the President does not belong.
State officials do not take part in these votes.
The committee meets on convocation by its president and at least once a year. It is required to be convened within one month of the request of the Minister concerned or the prefect. The President shall adopt the agenda of the work and fix the date of the meetings.
The Secretariat of the Committee shall be provided by the Prefect of Mayotte or by a person designated by him.
Rapporteurs appointed by the President shall be responsible for the study and The presentation of the items on the agenda. They shall be chosen from inside or outside the committee.
A qualified person may be called by the President, if he thinks fit, to participate in the work of the committee with a consultative voice.
Committee member functions are free.
Members of the committee who do not have the status of public servant or agent and who do not reside in the city where the committee is based are provided with Travel and subsistence allowances under the conditions laid down in the aforementioned decree of 12 April 1989 and are compensated according to the rates and rates applicable to employees classified in Group II.
The Minister of Interior, Internal Security and Local Freedoms, the Minister of Economy, Finance and Industry, the Minister of Ecology and Sustainable Development, and the Minister of The Overseas shall be responsible for the execution of this Decree, each of which shall be published in the Official Journal of the French Republic.
