In the light of Law No. 83-634 of 13 July 1983 as amended on the rights and obligations of civil servants, Act No. 84-16 of 11 January 1984 as amended laying down statutory provisions relating to the public service of the State, in particular Articles 73, 79 and 80;
Having regard to the amended Decree No. 85-1534 of 31 December 1985 laying down the statutory provisions applicable to engineers and The technical and administrative staff of research and training of the Ministry of National Education;
In the light of Decree No. 86-493 of 14 March 1986 laying down the exceptional conditions for the integration of non-incumbent employees of the Ministry of Education The national education, the Ministry of Culture and the Ministry of Youth and Sports in the bodies of category C officials, as amended by Decree No. 98-13 of 7 January 1998;
In the light of Decree No. 90-712 of 1 August 1990 concerning Common statutory provisions applicable to the bodies of administrative officials of the administrations of the State, as amended by Decree No. 97-414 of 25 April 1997;
Having regard to Decree No. 90-713 of 1 August 1990 on statutory provisions Applicable to the bodies of administrative assistants of the administrations of the State, as amended by Decree No. 98-1156 of 18 December 1998;
Having regard to the opinion of the Higher Council of the Public Service of the State (Committee on the Statute) of 25 January 2002;
The Conseil d' Etat (Finance Section) heard,
Describes:
In Article 1 of the aforementioned decree of 14 March 1986, the words: " The correlation table annexed to this Decree. " Are replaced by the words: " The correlation tables appended to this Order. "
The correlation tables annexed to the above-mentioned Decree of 14 March 1986 are supplemented by Annex IV, appended to this Decree.
It is added to the Decree of March 14, 1986, an article 4 bis reads as follows:
" Art. 4 bis. -For non-incumbent agents belonging to the categories referred to in Annex IV below, the period laid down in the first subparagraph of Article 4 shall be counted from the date of publication of Decree No 2003-37 of 8 January 2003
The agents mentioned In this Article must not have already had the possibility to apply for their tenure in a corps of officials pursuant to Chapter X of the aforementioned Law of 11 January 1984. "
The Minister of Youth, National Education and Research, the Minister of Economy, Finance and Industry, the Minister of the Public Service, State Reform and Planning Territory, the Minister for Sport and the Minister responsible for the budget and budgetary reform shall each have responsibility for the implementation of this Decree, which shall be published in the Official Journal of the French Republic.
