Decree of 15 January 2002 on application in public scientific and technological establishments and the Centre for the Study of the Employment of Articles 1, 5, 9 and 10 of Decree No. 2000-815 of 25 August 2000 on the development and reduction of working time in the state civil service

Minister of Employment and Solidarity, Minister of Foreign Affairs, Minister of Equipment, Transportation and Housing, Minister of Agriculture and Fisheries, the Minister of Public Service and State Reform, the Minister of Research, the Minister for Health, the Minister for Cooperation and the Francophonie, the Secretary of State for the Budget, and the Secretary of State for Industry,
In view of Decree No. 2000-815 of 25 August 2000 on the development and reduction of working time in the public service of the State, in particular Articles 1, 5, 9 and 10;
Having regard to Decree No. 2002-69 of 15 January 2002 establishing The scheme of the participation premium to scientific research in certain public scientific and technological institutions;
Having regard to Decree No. 2002-70 of 15 January 2002 on compensation for periodic penalty payments in certain Public scientific and technological establishments and the Centre for the Study of Employment;
In view of the Decree of 31 August 2001 on the development and reduction of working time in public scientific establishments And the Centre for Employment Studies;
In the opinion of the Joint Technical Committee on Higher Education and Research dated December 7, 2001,

Special work requirements and constraints, as well as work-related obligations that may be subject to certain staff in public institutions of a scientific nature, and The technology and the Job Study Centre correspond to the following situations:
a) Night work, Sunday, holidays;
Work on Saturday outside the usual hours of operation of the service;
b) Work in Staggered hours, before 7 hours or after 19 hours, subject to a minimum of two hours of work;
A significant change in the weekly working hours compared to the duration provided for in Article 3 of the decree of 31 August 2001;
(c) Work which leads to frequent and prolonged displacements, outside normal hours and the usual place of work, and necessary for the performance of the regular duties of the agent in the course of his or her main activity. Travel between the home and the usual place of work is not part of the actual working time. Casual travel does not count as a work-related displacement, constraint or obligation.

A penalty payment may be in place for the purposes of the service during the week, night, Saturday, Sunday or public holidays in the following cases:
-to perform operations of Maintenance of buildings and technical installations;
-to carry out all operations to ensure the safety of installations, goods and persons;
-to enable the continuous operation of services, in particular Computer systems, scientific equipment and experimental devices.

The situations listed in Article 1 above which have not resulted in an increase in the premium for participation in research shall be compensated by rest periods.
Compensation in time of rest On Sunday or on public holidays, night work, work performed on a Saturday outside the usual hours of operation of the service referred to in Article 1 of this Order, shall consist in the granting of a rest Compensation equivalent to 50 % of the duration of this period.
The compensation in respect of rest of the situations referred to in Article 1 of this Order shall consist in the granting of compensatory rest equal to a percentage of the duration of the Work performed. The percentages are as follows:
-in staggered work situations, it is 20 % of the duration of the job;
-in situations of significant change in the weekly working time, it is 10 % of the overrun Period laid down in relation to the duration provided for in Article 3 of the decree of 31 August 2001.
The compensation in time for rest of the situations referred to in the c of Article 1 of this Order shall consist in the granting of compensatory rest Up to 2 hours a day.

Home periodic penalty payments which have not been offset by an increase in the incentive grant shall be compensated in time of rest according to the following procedures:
a) Time Periodic penalty payments shall give rise to compensation in time of rest by 10 % of the duration of the periodic penalty payments;
(b) The time for intervention during the penalty payment shall give rise to an increase in hours worked by 50 %.

This Order takes effect on January 1, 2002 and will be published in the Official Journal of the French Republic.
