CIRCULAR rules on impact assessment of climate change and climate assessment of the national hydro-meteorological Law base on November 23, 2015;
Pursuant to the law on environmental protection on June 23, 2014;
Pursuant to Decree No. 21/2013/ND-CP of March 2013 of government functions, tasks, powers and organizational structure of the Ministry of natural resources and the environment;
At the suggestion of Director of Department of meteorology hydrology and climate change and Director of Legal Affairs;
The Minister of natural resources and the environment issued a circular regulating the impact assessment of climate change and the national climate assessment.
Article 1. Scope this circular detailed rules on impact assessment of climate change and the national climate assessment as specified in clause 8 of 33 Things hydro meteorological Law.
Article 2. The object that applies to this circular apply to agencies, organizations, individuals with activities related to the impact of climate change and the national climate assessment.
Article 3. Explanation of terms 1. Climate change adaptation is the adjustment of the natural and human systems to suit the new environment or environment changed, aims to reduce the possibility of injury due to climate change and take advantage of the positive effects due to climate change.

Article 4. The information, data, information assessment service data service reviews the impact of climate change, adaptation solutions, assessment and mitigation of climate change and the national climate assessment including: 1. climate change scenarios by Ministry of natural resources and environment announced at the time of the most recent reviews.

Article 5. Reviews the impact of climate change 1. Reviews the impact of climate change, including the analysis, reviews the impact of positive, negative, short term, long term of climate change to natural disasters, resources, the environment, the ecosystem, living conditions, social-economic activities and interdisciplinary issues, contact the region, contact the field specified in clause 5 Article 33 Hydrology Meteorology Law in order to determine the socio-economic objective, long-term goals of the strategy, planning, plans to list environmental assessment implementation strategy. The content reviews follow the provisions in paragraphs 2, 3, 4 and 5 of this paragraph.
2. Assess the impact of climate change to natural disasters including reviews of the scope, intensity, and frequency of the hydro-meteorological disasters.
3. Assess the impact of climate change to include resources to impact assessment of water resources, land resources, forest resources, marine and island resources, minerals, energy, biodiversity.
4. Assess the impact of climate change on the environment, the ecosystem, including: a) the Naval, hydraulic fluctuation dynamics of the sea: waves, tidal flow, the water surges, saline intrusion; erosion, accretion of coast;
b) hydrological fluctuations in surface water, groundwater hydrology, flood, flooding, flash floods, avalanche;
c) meteorological fluctuations in climate: droughts, frosts, hot sun, rain;
d) fluctuations due to land erosion, accretion; land degradation due to desertification, salinity intrusion;
DD) terrestrial ecosystems, ecosystems, ecosystem region under water and other ecosystem;
e) other content related to strategy, planning, planning.
5. Evaluate the impact of climate change to the socio-economic activities and interdisciplinary issues, contact the region, contact the field, including the following: a) reviews the positive effects, negative, short term, long term of climate change to the social-economic activities related to the scope of the strategy , planning, plan;
b) evaluate positive effects, negative, short term, long term climate change related issues, contact the region, contact the field.
6. The sequence of the impact assessment of climate change: a) defines the object and scope of the evaluation;
b) analysis, the choice of assessment tools, methodology, model reviews and evaluation indicators;
c) reviews the impact of climate change to natural disasters, resources, the environment, the ecosystem under the content specified in the clause 2, 3 and 4 Article 5 this circular;
d) reviews the impact of climate change to the socio-economic activities and interdisciplinary issues, contact the region, contact the field according to the content of the provisions in clause 5 article 5 this circular;
DD) general assessment report.
Article 6. Evaluate the solutions adapt and mitigate climate change 1. Strategy, planning, plans to list made the strategic environmental assessment, in the building process to evaluate the solutions adapt and mitigate climate change as defined in paragraph 2 and paragraph 3 of this article.
2. Evaluate the solutions to adapt to climate change: a) the reality of solutions to adapt to climate change in strategy, planning, plan, including the analysis reviews the pros, cons, causes and solutions;
b) the effectiveness of the solutions to adapt to climate change to the social-economic activities in strategy, planning, planning.
3. Evaluate the solutions to mitigate climate change: a) the reality of solutions to mitigate climate change mitigation strategy, planning, plan, including the analysis of advantages, disadvantages, causes and solutions;
b) the effectiveness of the solution to climate change mitigation of the socio-economic activities of local branches in strategy, planning, planning and the ability to replicate.
4. The order of evaluation of the adaptation and mitigation solutions to climate change: a) analysis, the choice of the adaptation and mitigation solutions to climate change needs reviews related to the scope of the strategy, planning, plan;
b) analysis, the choice of assessment tools, indicators, evaluation method;
c) assessment of the status of the adaptation and mitigation solutions to climate change related to the scope of the strategy, planning, plan;
d) reviews the effectiveness of the mitigation and adaptation solutions to climate change to the social-economic activities of local branches;
DD) general assessment report.
Article 7. National climate assessment 1. Content of the national climate assessment made in accordance with paragraph 1 Article 35 law on hydro-meteorological and details are as follows: a) reviews the content defined in art. 1 Article 35 hydro meteorological Law, include: characteristics of the climate of Vietnam to the point reviews; of temperature, rainfall, storms, tropical depressions, rain, sea-level rise, saline intrusion and extreme climate phenomena such as floods, flash floods, heat, drought, frosts, hail damage, medium-dark, salt fog;
b) reviews the content specified in point b of paragraph 1 Article 35 hydro-meteorological Law, including: assessment of climate elements, extreme climate treatment, extreme climate phenomena; rate of change of climate factors and the treatment of the climate; the differences compared with average global climate and past evaluation reports;
c) reviews the content specified in point c of paragraph 1 Article 35 hydro-meteorological Law according to the provisions of article 5 of this circular;
d) reviews the content specified in point d of paragraph 1 Article 35 hydro-meteorological Law as defined in article 6 of this circular;
DD) reviews the content of the provisions in Article 35 paragraph 1/e point meteorological hydrological Law, including: the relevance of climate change scenario compared to the actual happenings of the climate in the reviews; the level of use of climate change scenarios for adaptation and mitigation activities to climate change in the period reviews.
2. States of national climate assessment is made according to the provisions in clause 2 Article 35 hydro-meteorological Law.
Article 8. Implementation 1. 2. The evaluation is done according to the provisions in paragraph 3 Article 37 law of meteorology hydrology.
3. The Bureau of hydrology, meteorology and climate change help the Minister of natural resources and the environment implementation of national climate assessments as specified in article 7 of this circular.
Article 9. Effective enforcement of this circular are effective since July 1, 2016.
Article 10. Responsibility 1. Director of Department of meteorology hydrology and climate change is responsible for guiding, urge, examine the implementation of this circular.
2. Ministers, heads of ministerial agencies, Chairman of the people's Committee of the central cities, and bodies of relevant organizations, is responsible for the implementation of this circular.
